SDA seeks $250m compensation from McDonald’s operators who allegedly denied paid breaks to Australian workers

McDonald’s has been slapped with a wage theft claim of at least $250 million in the Federal Court over alleged denial of paid breaks to workers.

The Shop, Distributive and Allied Employees’ Association (SDA) is seeking compensation on behalf of more than 250,000 current and former McDonald’s workers across Australia.

If successful, the union said the claim would be one of the largest of its kind in Australia’s history.

The SDA is alleging workers at more than 1,000 current and former McDonald’s sites were denied their uninterrupted 10-minute break when working four hours or more during a shift.

South Australia branch secretary Josh Peak said McDonald’s workers were told if they want their paid break, they cannot get a drink or go to the toilet.

He said in almost two years of investigation the union had heard more than 10,000 accounts from former and current employees, including young Australians, at McDonald’s stores across Australia.

“Workers were systematically, deliberately denied the rights to those breaks,” Mr Peak told ABC Radio Adelaide Breakfast.

“It’s just not good enough that a large employer such as McDonalds would create a scheme that leads to people not being paid correctly or getting base entitlements.”

The statement of claim alleged workers had to seek permission to get a drink or go to the bathroom and could be directed to resume work before their 10-minute break was up.

Mr Peak said workers were misled or not informed about their rest break entitlements and the multi-billion dollar corporation should be penalized for it.

“It is really outrageous behavior to be tricking young people into thinking they are not entitled to go the toilet if they used their paid entitlements,” he said.

“Workers never got their paid 10-minute rest break and when workers did ask for it, they were told ‘we don’t do that here because you can go the toilet whenever you like’, which is completely ludicrous.”

The claim named 323 McDonald’s operators who allegedly denied paid rest breaks to workers over the past six years.

McDonald’s Australia issued a statement in which it denied the claims.

“McDonald’s believes its restaurants complied with applicable instruments, provided rest breaks to employees and were consistent with historic working arrangements,” a McDonald’s spokeswoman said.

“Those arrangements have been known to the SDA for many years. The manner of taking breaks has not been challenged or raised by the SDA as a matter of concern throughout successive enterprise bargaining processes for new industrial agreements.

“We are very mindful of our obligations under applicable employment laws, including the former enterprise agreement and the Fast Food Industry Award, and continue to work closely with our restaurants to ensure employees receive all correct workplace entitlements and pay.”

Claim originates from SA

The new claim is in conjunction with the SDA’s 15 existing Federal Court claims against McDonald’s Australia and 14 franchisees — seven of them in South Australia.

In December 2020, 14 McDonald’s employees at the Frewville and Mount Barker restaurants lodged a compensation claim after allegedly being denied their 10-minute rest break.

As a result of that action, the investigation extended nationwide.

Isabelle, who worked at McDonald’s in the Adelaide CBD for almost five years, said she was not given her entitled 10-minute break, but instead was allowed drink breaks freely during shifts.

“The drink break was only for 20 seconds, or as fast as you could drink and then come back to work straightaway,” she said.

“I’d spoken to my bosses about it and they just told us that we didn’t get them, they chose to do something different, and that it was legal, it was all fine.

Experienced migrants struggle to find jobs as industry cries out for skilled workers

When Vitaly Bazarov and his wife Anna Shmatko moved to Melbourne in June, they knew they could have a better life for their daughter than they would have in Ukraine.

Speaking through an interpreter, Ms Shmatko said, “I’m a Ukrainian patriot, but I fell in love with Australia the moment I got here.”

After being displaced by the war in Ms Shmatko’s home country, the pair came to Australia with their daughter Mariia, and used Facebook to make friends and find support.

But despite being an experienced boilermaker and diver, Mr Bazarov has been unable to find employment.

“This is a great country, but the services are expensive, I am really hoping one of my past careers can help me find a profession here so I can better support us,” he said.

Ms Shmatko believes employers discount her husband’s qualifications because English is not his first language.

“Finding the right people who will appreciate his skills and what he can do has been so hard,” she said.

Since arriving, the couple have been improving their English and actively seeking employment.

One of the ways they have been looking for work is through online groups on social media that aim to help refugees and immigrants settle into Australia.

It was through one of these groups the pair met Svetlana Khaykina, who volunteers her time to help people who have recently arrived find work and understand the Australian job market.

Writing CVs for refugees

Ms Khaykina, an engineer living in Port Hedland in WA, grew up in Belarus and can communicate proficiently with people from other Slavic language groups.

She has written over a dozen resumes for people, including Mr Bhazarov.

“Writing a CV is a very new thing for a lot of people when they first arrive; most people have no idea to start, it’s not a practice in Ukraine,” she said.

“I can see that Vitaly is extremely marketable especially in places like Port Hedland, he just needs to be given a chance.”

When Ms Khaykina sees job opportunities posted online, she tries to connect employers with immigrants and act as a translator if needed.

In her view, one of the biggest hurdles besides the language barrier is Australia not recognizing overseas certifications.

“People like Vitaly have decades of relevant experience, but even if he finds work he’ll probably have to work at a lower position like a trade assistant which doesn’t require certification,” she said.

Australia needs workers

Australian Resources and Energy Employer Association (AREEA) data suggests the country will need at least 20,000 more workers to join the resources and energy sectors by the end of 2027.

Western Australia will require at least 11,250 of these employees.

AREEA chief executive Steve Knott said the industry was battling the worst skills crisis in a generation.

“Simply, unless industry and government can find some creative solutions, the skills crisis facing not only the resources and energy industry, but all sectors of the Australian economy, will persist for years to come,” he said.

Ms Khaykina said the wide range of highly skilled refugees arriving in Australia was mind boggling, but what was more surprising was the lack of job offers.

“Living in Port Hedland I know there’s a huge labor shortage and as an engineer I’m coming across welders, fitters, engineers, construction workers and all sorts of people.

“But they’re not being given a chance,” she said.

“Especially in Hedland, we need divers like Vitaly to do pile repairs and maintenance, we are always looking for more people with those skills.”

What support is available?

Ms Khaykina said with no end to the war in Ukraine in sight, she would love to see more effort from the Australian government to help resettle people.

“In my understanding there’s about 10,000 Ukrainians in Australia, while 9 million have fled the war; it’s such a great tragedy,” she said.

“When they do get here, they have limited humanitarian visas.”

The Department of Home Affairs said it had granted more than 8,600, mostly temporary, visas to Ukrainians in Ukraine and hundreds elsewhere.

A spokesman said Ukrainian nationals in Australia who were unable to accept the offer of a Temporary Humanitarian Stay could access other visa options.

The government had provided $450,000 to the Australian Federation of Ukrainian Organizations to assist their work to support those arriving in Australia, the spokesman said.

And more than 1,300 Ukrainians had registered with the government’s Adult Migrant English Program, aimed at assisting new migrants and humanitarian entrants to learn English language skills.

Ms Khaykina believed if the government supported qualified refugees and immigrants to secure skilled work it would help solve the skills shortage and provide Ukrainians with a better life in Australia.

While assistance in finding skilled work could be limited, Ms Khaykina said support was available through community legal services.

Victoria Malyk, a migrant support worker in the Pilbara, said there was assistance for those who had recently arrived.

“I can respond to their needs such as help with employment and English lessons through the Settlement Engagement and Transition Support program or SETS.”

The program is available to eligible clients, such as refugees and skilled regional workers in their first five years of living in Australia.

From Ms Malyk’s perspective, one of the biggest barriers facing these people are restrictions for some visa holders in accessing subsidized TAFE courses.

She said they usually could not afford high commercial fees.

“Further training is often needed for recognition of prior learning and overseas qualifications,” Mr Malyk said.

For now, Mr Bazarov will keep looking for work where he can use his decades of experience.

“We just need a chance,” he said.

“Once we find somebody who knows the industry and recognizes my skills, I’m sure they would want to take me, I’d be a great asset to any company.”

D-Link R15 AX1500 Smart Router Review: A solid entry-level option

D-Link’s new Eagle Pro AI series of routers is looking to shake things on both sides of the market, from entry-level routers-to premium mesh systems. The R15 AX1500 Eagle Pro AI stands as the entry-level option, but provides some nifty value through its compact design, Wi-Fi 6 functionality and various smart features including Google Assistant and Amazon Alexa voice control commands, that this side of the market have been missing as of late. It might not jump out at users in any particular way, but still serves as a worthy upgrade for those looking for Wi-Fi 6 connectivity, or as a basic upgrade for those rather bare-bones routers provided by most internet and telco providers.

Design

Much like its sibling, the G415 4G Smart Router, the R15 is rather compact an unassuming, sporting a flat white paint job and four side antennas. Unlike the G415, the R15 does sit flat on its back rather than standing upright, meaning it might take up a little more room in some spaces. That being said, the R15 is one of the smallest routers I’ve ever used, so I can’t imagine both the size and orientation being too much of an issue for most users.

The back of the router also sports three Gigabit Ethernet LAN ports, and a single Gigabit Ethernet port for even faster transfer speeds, the latter of which is now becoming a standard for all levels and tiers of internet routers. Beyond this, there’s admittedly not much going on with the router, which isn’t necessarily a bad thing. Its smaller size allows it to be tucked away, while the only thing I can truly point out regarding the overall appearance and design of such a router, is that the flat white colourway may stand out, particularly if your internet setup is located in a central position in the home.

Performance

In terms of performance, the R15 plays things relatively straight. With the ability to hit speeds of up to 1,201Mbps on 5GHz band and 300Mbps on the traditional 2.4GHz, most Australian users will find the router capable of transmitting the fastest speeds our internet companies and telco providers have to offer. Unlike most entry-level routers and routers provided by the aforementioned internet and telco companies, the the R15 can cover a whopping 230 square meters, making it a no-brainer for both smaller and larger households alike, without the need to purchase any external or additional extenders.

That being said, the R15 does play friendly with the Eagle Pro AI range, meaning such extenders and even additional routers can easily be paired to the R15 via the Eagle Pro AI app. Much like the G415 4G Smart Router, the Eagle Pro AI Engine also keeps users tuned to the most reliable band at any given time, be it the 2.4GHz or 5GHz band, allowing multiple uses to consistently access the most efficient and reliable method of connectivity .

Software

Thankfully, the Eagle Pro AI app is incredibly friendly and easy to use. As we’ve covered most of the apps functionality and features in our D-Link G415 AX1500 4G Smart Router Review, we have included the relevant excerpt below, outlining a nearly identical experience in relation to the R15:

“It’s incredibly easy to navigate, and is responsible for additional features, including the aforementioned AI Mesh Optimiser and the handy AI Parental Control. As the name suggests, AI Parental Control allows users to monitor and manage their children’s online activities. From here, you can create a profile for individual users to block and minimize access to the internet. Aside from the rampant virus exposure that may be a cause for concern for some parents, certain sites can even be curbed thanks to a web filter.”

“The Eagle Pro AI App also allows for voice control through multiple platforms including the Google Assistant and Amazon Alexa. This might feel unnecessary for some, but is a welcome inclusion for those looking to turn their home into a smart, interconnected haven. The included AI Assistant can also whip up weekly reports for you incusing user activity and general internet traffic, with recommendations on how to solve the issues that may arise as a result. Overall, the app is incredibly easy to navigate and continuously informative at every step.”

Verdict & Value

Overall, the D-Link R15 AX1500 Smart Router is a reliable router for the entry-level price tag. Thanks to the Wi-Fi 6 compatibility, Eagle Pro AI app and compact design, it’s admittedly hard to pass this one up, should you be upgrading from a basic router provided by your internet provider, or imply looking to the future for Wi-Fi 6 support, which is arguably provided here at one of the cheapest price points in the market today. Impressive range will negate the need for extenders in most homes, while such a solution is incredibly easy to set up given the seamless functionality of the Eagle Pro AI app. If you’re looking for a solid all-rounder for an entry-level price tag, you might not need to look any further.

Square Enix Is Potentially Looking To Sell Stakes In Its Studios

Square Enix has been a mainstay in the industry for years, but it looks like the Japanese publisher and developer is struggling, having reported declining financial results for Q1 2023 (besides the huge success of its MMORPG, Final Fantasy XIV). And, following the publication of those results, Eurogamer reports that the company is looking to “improve capital efficiency” by selling stakes in its studies.

This comes from an internal conference call held after the results were shared, with MST Financial analyst David Gibson breaking down the discussion on Twitter.

Square Enix recently sold a number of its Western studios to Embracer Group, but that was only phase one of the company’s plans. The next stage is for Square Enix to diversify the studio’s capital structure, and be more selective with resources due to rising costs.

Resources will be focused on Japanese-developed games, with European and American studies impacting the most.

One way Square Enix thinks it will improve its capital efficiency and offset rising costs is by selling stakes in some of its studies. Gibson suspects that the likes of Sony, Tencent, and Nexon would be among the interested parties. What this means is that Square Enix won’t entirely sell studios, but rather a percentage of them,

Interestingly, once the sale with Embracer Group goes through, Square Enix will gain $1.4 billion and potentially remove any debt they have, Gibson states.

Following the call, Square Enix’s shares have risen. At the time of writing this, Square Enix Holdings Co Ltd has seen an 11% increase today.

The company has a huge slate of releases coming out at the end of this year, including on the Switch. The DioField Chronicle launches on the 22nd September, followed by the Switch port of NieR: Automata in October, farming sim Harvestella and Tactics Ogre: Reborn in November, and Dragon Quest Treasures in December. Crisis Core: Final Fantasy VII Reunion is also due out in the winter.

It’s also already released two fantastic games earlier in the year, and a long-awaited port — Triangle Strategy, Live A Live, and Chrono Cross. So it’s been a busy year for Square Enix. We’ll have to wait and see what happens with the company for the rest of the year.

Nintendo Rules Out Any Price Increase On The Switch In Japan… For Now

Amidst a weak yen in Japan, electronics are currently facing some serious price hikes, including the likes of Apple’s iPhone, but also encompassing a wide range of pretty essential goods including TVs, fridges, dishwashers, and printers.

One area that seems to be immune (for now) is the video game console market. According to Bloomberg (thanks, VGC), the three major console manufacturers – Nintendo, Sony, and Microsoft – were asked whether a price increase is on the cards in Japan in the near future. While Sony and Microsoft conspiciously declined to comment, Nintendo stated quite plainly that it has “no plans” to raise Switch prices.

Of course, plans can change at the drop of a hat, but it’s nonetheless reasonably welcome news for customers. As cited by Bloomberg, none of the console manufacturers want to be the first to raise the price of their products, but what this currently means is that consoles in Japan are effectively $100 cheaper than anywhere else.

On the flipside, as a result of companies not opting to raise their prices, this has also led to scalpers in Japan buying consoles and selling them on again at a profit at the most opportunistic time, further increasing demand in the country and driving profits away from shareholders. As such, an eventual price increase may seem almost inevitable.

One likely reason that Nintendo is declining to raise the price of the Switch is that all models are still selling like hotcakes in Japan. Just last week, Nintendo managed to sell almost 70,000 Switch units, whereas the PlayStation 5 managed just over 11,000. It’s clear that Nintendo sees no reason to raise its prices when its products are still performing so well. Nevertheless, as the yen weakens, Nintendo is expected to report a profit loss as part of its next financial results.
