Former Ashley Youth Detention Center detainees lodge class action over alleged abuse

More than 100 former detainees of Tasmania’s Ashley Youth Detention Center have lodged a class action in Tasmania’s Supreme Court, alleging they were whipped, kicked, bullied, encouraged to join gangs, sexually abused and stripped naked.

Warning: This story contains details some readers may find distressing.

The court documents include numerous allegations made by four plaintiffs, with the action launched on behalf of another 101 former detainees.

Out of the 101, the earliest claimant alleges abuse dating back to 1961, while the most recent is from 2019.

“That’s a span of just under 60 years,” lawyer for the plaintiffs Angela Sdrinis said.

“On one level it was surprising and appalling. On another level we know children in care, not just in Tasmania but in Australia and around the world, have been victims of abuse.”

The court documents detail the claims of the four men, dating back to the early 1990s.

They allege the former detainees were physically or sexually assaulted by staff or other detainees at the Ashley Youth Detention Center (AYDC) and their complaints about the incidents were dismissed.

The plaintiffs say that as far as they were aware, complaints were not recorded and no action was taken.

In particular, it is claimed that staff would enter detainees’ cells to commit physical and sexual assaults or deliberately leave doors unlocked, knowing that detainees would enter the rooms, sometimes as gangs, “to commit violent physical and sexual assaults on each other.”

One man, known as JC, alleged that he found the body of another inmate the morning after the inmate was beaten by staff. A coronial inquiry found the assault had taken place two weeks earlier and cleared the staff.

Another plaintiff, known as CA, alleged that after he fought off a sexual attack by a staff member, he was assaulted by other staff members, knocked unconscious, and locked in an isolation cell naked for five days with only a blanket.

He also said that on numerous occasions he was exposed to the sounds of other detainees being sexually assaulted in their cells by staff at night.

The third plaintiff, RI, claimed that after he refused to perform oral sex on a staff member, he was “punched and knocked out by other staff” and had to go to Launceston General Hospital.

All four men allege they now have post-traumatic stress disorder due to their time there, with some experiencing frequent flashbacks, nightmares and suicide attempts.

AYDC ‘didn’t vet staff properly’

The claim also takes aim at staff hiring, training and supervision at the detention center.

It is alleged that not only did some of the staff have sexual or physical allegations against them, but there were also members of outlaw motorcycle gangs such as the Rebels and Outlaws working at the centre.

One plaintiff claimed that on numerous occasions he saw staff members encouraging details to contact gang members when they were released.

It is alleged that AYDC did not vet staff properly and had no — or at least not adequate — systems for de-escalating confrontations with detainees or supervising staff to ensure they were not verbally, physically or sexually abusive.

Instead, it claimed staff used inappropriate force, punished detainees who tried to make complaints against other staff, assaulted them and exposed them to other detainees who were known or alleged to have engaged in physical or sexual violence against previous detainees.

In one example, JC alleged that after he misbehaved, he was removed by four guards who proceeded to abuse him.

“[They] grabbed him by the neck, threw him to the ground, kicked him in the ribs, and dragged him across the yard to his cell, where he was thrown onto a wooden bed and held down with pressure to his neck until he lost consciousness,” the document says.

“When JC regained consciousness three hours later, he was naked and handcuffed. JC was not provided with medical attention.”

‘Don’t forget, children as young as 10 were sent to Ashley’

Plaintiffs also described instances of being shoved, throttled, punched, whipped, stripped naked, almost drowned, abused to the point where they needed to be hospitalized, and denied medical attention after suicide attempts.

The claims also detail degrading strip searches with guards who would harass and laugh at details.

“A common occurrence when children were admitted to Ashley was that they would be strip searched,” Ms Sdrinis said.

“They’d have the scabies cream applied to them whether or not they had scabies… we’ve been told it burnt the skin, including in the genital area.

“Don’t forget, children as young as 10 were sent to Ashley.”

But these allegations are not revelations.

The issues with the detention center are well known and just last year the state government announced it would close it down.

It is also about to be the subject of the Commission of Inquiry into Institutional Responses to Child Sexual Abuse, with hearings set to start late next week.

“I believe the evidence that will come out of the public hearing into Ashley will be very confronting as well,” Ms Sdrinis said.

A spokesperson for the state government said they were unable to comment as “legal action has been flagged.”

“The Commission of Inquiry will be examining the AYDC in the upcoming hearings and as we have shown, we will not hesitate to act where required to ensure our children and young people are safe,” they said.

Two men arrested over alleged assault and robbery of 20-year-old man last month

ACT police are still searching for a third man who was allegedly involved in assaulting a 20-year-old until he was unconscious in Canberra’s north last month.

ACT Policing said the alleged victim had stopped in the suburb of Hawker to offer assistance to a man he thought appeared to be lost about midday on Saturday, July 23.

That man allegedly then assaulted the 20-year-old, along with another two men who had been hiding nearby.

Police said that the 20-year-old was threatened with an icepick before he lost consciousness and that his shoes and wallet were stolen.

Police said the man’s account details were then used by his alleged attackers to commit credit card fraud.

When the man regained consciousness he was taken to the Canberra Hospital.

Police investigating the incident executed two search warrants yesterday, and arrested two men, who the ABC understands to be Kobi Guarini, 33, and Kalani Joliffe-Cole, 25.

Officers said that during the searches, they located the items alleged to have been stolen, and a detection dog found firearm components including shells, a barrel, a stock and an item they believed to be a suppressor.

Police said both men appeared in the ACT Magistrates Court yesterday.

It is understood Mr Guarini was charged with aggravated robbery, possession of stolen property and two counts of obtaining property by deception.

Mr Joliffe-Cole is believed to have been charged with aggravated robbery.

Courtney Clenney, the OnlyFans and Instagram model who stabbed her boyfriend to death in Miami in April, has been arrested on a murder charge, the Miami Herald has learned.

The 26-year-old Clenney was taken into custody on Wednesday in Hawaii, and will eventually be extradited to Miami-Dade County to face trial. She’s being charged with second-degree murder with a deadly weapon for the April 3 stabbing of Christian “Toby” Obumseli, who was a native of North Texas.

Obumseli’s family in Richardson, in the Dallas-Fort Worth area, told Star-Telegram media partner WFAA-TV that they set up a GoFundMe page, which described Obumseli as “extremely compassionate with a desire always to uplift those around him.” The GoFundMe had raised about $82,500 of its $100,000 goal on Thursday.

Clenney’s arrest was confirmed Wednesday afternoon by her Miami defense lawyer, Frank Prieto, who said she’d been in Hawaii while in rehabilitation for substance abuse and post-traumatic stress disorder.

“I’m completely shocked, especially since we were cooperating with the investigation and offered to voluntarily surrender her if she were charged,” Prieto said. “We look forward to clearing her name in court.”

The Miami-Dade State Attorney’s Office, in a press release on Wednesday evening, said the arrest warrant remained sealed. State Attorney Katherine Fernandez, along with City Police Chief Manuel Morales and South Florida US Marshal Gadyaces Serralta, were expected to detail the arrest at a press conference on Thursday afternoon.

Obumseli worked in cryptocurrency. Known as Courtney Tailor on her social-media platforms, Clenney boasted over two million followers on her social-media platforms.

She and Obumseli had been dating less than two years, and their relationship had been plagued by domestic strife — she’d once been arrested for domestic battery in Las Vegas, and police had been called to their home in Austin, Texas, on several occasions .

The two had only lived in Miami for a few months at the One Paraiso building, 3131 NE 7th Ave., where staff members had documented numerous domestic disturbance complaints about the couple and had even moved to evict them.

Clenney and Obumseli had broken up several times, although investigators believe that he’d moved back into the apartment by the first day of April. The Miami Herald earlier reported that Miami police responded to the apartment on April 1, two days before the stabbing, over another domestic disturbance call.

Finally on the evening of April 3, just before 5 pm, Clenney frantically called 911 to report Obumseli had been stabbed.

Australian man Robert Pether’s health deteriorating 16 months after ‘arbitrary detention’ in Iraq began

There are serious fears for the health of an Australian man languishing in an overcrowded Baghdad jail, with doctors arguing he needs urgent surgery to treat multiple suspected skin cancers.

Robert Pether, 47, has been behind bars in Iraq since April last year, found guilty of what his family and legal team described as trumped-up fraud charges.

United Nations investigators have raised concerns Pether, and his Egyptian colleague, Khalid Zaghloul, have been exposed to torture techniques while imprisoned.

Pether’s family spent nine months trying to get him access to medical experts in Iraq, after a photo of injuries on his back was sent to a doctor in Italy.

“His doctor was absolutely appalled at the state of him,” Pether’s wife Desree told the ABC.

“He’s got so many new moles on his back, he’s got a new mole on the same ear that he had a melanoma before, and it has changed significantly in the last few months.

“It’s displaying the same aggressive behavior as the melanoma that he had.”

He now needs to have seven potential cancers cut out but there is no guarantee he can access the care he needs in Iraq.

“Our doctors stated that he looks 74, not 47, and he looks very frail, like a frail old man,” she said.

“He’s completely grey, and his skin tone is grey.

“There’s also [the risk of] post-operative infection when he’s in a 14-foot cell with 22 other men.”

Pether’s doctor has gone so far as to write to Prime Minister Anthony Albanese.

Ms Pether said her husband was “absolutely terrified” about the situation, and his mental health was deteriorating.

“He’s in a really dark place,” she said.

“It’s really, really hard to be in a position where you have to talk him off of a ledge quite frequently.

“And for our 19-year-old son to get off the phone and be in tears because of the way his dad’s talking, and thinking that his father’s going to do something drastic, it’s really difficult.”

Pair face further charges

Pether, an engineer, had been working on the construction of the new $1 billion Central Bank of Iraq (CBI) headquarters in Baghdad, when he was arrested alongside his colleague Zaghloul.

In August last year, an Iraqi court found the pair guilty of deception charges which carried a $16 million fine and five years in jail.

Since then, the two men have been hit with further charges as CBI has tried to enforce further ends for delays in the project.

The case has been put off until later this month.

Ms Pether had been highly critical of the Morrison government’s approach to her husband’s case, saying her family felt abandoned.

She said there had been a “marked difference” in the approach of the new government.

“It’s chalk and cheese,” Ms Pether said.

“I’m hoping that they’re able to do something a little bit more significant … in respect to trying to get him out.”

In June, Mr Albanese spoke to his Iraqi counterpart, Mustafa Al-Kadhimi.

An official transcript of the conversation from the Iraqi government did not mention Pether’s case but sources have told the ABC the matter was raised.

The ABC has contacted Foreign Minister Penny Wong’s office for comment.

Diplomats working ‘around the clock’

Last week, Labor MP Peter Khalil took to his feet in federal parliament to raise Pether’s situation.

“The strain on Robert is terrible, but so is the pain of his family — the pain they’ve had to endure for over 16 months — his wife, Desree, and his children, Nala, Oscar and Flynn,” he told the House of Representatives.

“The Pether family have sold a property to help pay for Robert’s legal fees, and, I think, a car as well. All they want is Robert to return home safely.

“His daughter, Nala, draws pictures of what she plans to do with Dad when he gets out and is back home. Desree tells me it’s hard to keep the kids’ and Robert’s hopes up.”

Mr Khalil said diplomats were working “around the clock” on the case, and hoped the Iraqi government might grant him clemency based on his deteriorating health.

Mount Isa man in custody over alleged murder of 13yo girl

Mount Isa man Trevor Caulton has been arrested and charged with murder after he allegedly drove a vehicle into a crowd of people, hitting and killing a 13-year-old girl.

Emergency services were called to the corner of Delacour Drive and Dent Street in the Mount Isa suburb of Pioneer after midnight on August 6 and treated the girl for critical head injuries.

Police confirmed she succumbed to her injuries and died at the scene.

Mr Caulton’s lawyer appeared on his behalf via phone at the Mount Isa Magistrate’s Court on Monday.

A full brief of evidence was being prepared and the case would appear for mention at Mount Isa Magistrate’s Court on September 26.

The victim was identified and her family had been contacted, police said.

“I do have concerns about unrest in the community — this is a distressing case and this poor girl’s life has been taken,” said Mount Isa Police Acting Superintendent Jason Smith.

“We acknowledge the grief in the community and we implore everyone to remain calm around this incident and to assist police with the investigation.

“Sometimes in our community there can be an urge from some to seek retribution. Please know the law has been executed, the alleged offender is in jail and police have done as much as they can.”

A Massachusetts man is facing a murder charge in connection with the stabbing death of his great aunt in Lowell, according to authorities. The Middlesex District Attorney’s Office announced Sunday that 22-year-old Rayshawn Settles, of Lowell, was arrested Saturday without incident at the Saint’s Campus of Lowell General Hospital. Settles had been civilly held at the hospital since Aug. 1. According to the DA’s Office, surveillance video and DNA evidence tied Settles to the July 31 death of 64-year-old Linda Gilbert, also of Lowell. On July 31, Lowell police responded to a house on Loring Street shortly before 11:20 pm Sunday after receiving reports of an unresponsive woman inside. Gilbert was found inside the home with apparent trauma and transported to Lowell General Hospital, where she was pronounced dead. The state’s Office of the Chief Medical Examiner ruled Gilbert’s death de ella to be a homicide and that the cause of her death de ella was multiple stab wounds. Authorities said investigators were able to find surveillance video of Settles, Gilbert’s grand-nephew, walking to and from the Loring Street home around the time of the murder. Investigators were also able to find clothing Settles allegedly wore during the murder. Testing at the Massachusetts State Police Crime Laboratory found that those clothes had Gilbert’s DNA on them. Settles is expected to be arraigned Monday in Lowell District Court. The case was investigated by the Middlesex District Attorney’s Office, state police detectives assigned to the DA’s Office and Lowell police.

Irvine: Orange County dermatologist Yue Yu arrested on suspicion of poisoning husband

IRVINE, Calif. — Police have arrested an Orange County woman for an investigation of poisoning her husband.

Police in Irvine say a man reported Thursday that he believed he was being poisoned by his wife of 10 years after he grew ill over the course of a month.

The man had video evidence he also provided to authorities, police said in a statement. He had internal injuries but is expected to recover, the statement said.

Yue Yu, 45, was arrested Thursday after investigators interviewed her and searched the couple’s home, the statement said. She is due to appear in court Monday and is being held on a $30,000 bail, online jail records show.

It was not immediately known whether Yu had an attorney.

Providence Mission Hospital, where Yu can see patients, said in a statement Friday that the hospital is cooperating with police and the incident was a domestic issue and has not affected patient care.

Nebraska State Patrol says arrest made in relation to 4 homicides in Laurel

A 42-year-old man was arrested Friday in connection with the four homicides early Thursday morning in Laurel, Nebraska, according to the state patrol. Crime scene investigators found evidence that linked Jason Jones, a Laurel resident, to the homicides. After attempts for Jones to exit the home voluntarily, the Nebraska State Patrol SWAT Team entered the home and found Jones with severe burn injuries, according to law enforcement. NSP said he was airlifted to a Lincoln hospital and is in serious condition as of Friday morning. The Nebraska State Patrol also believes gunfire played a role in the deaths at two separate homes in the northeast Nebraska town. Around 3 am, the Cedar County Sheriff’s Office responded to a call about an explosion at a residence in Laurel and fire teams found a person dead inside the home, according to the Nebraska State Patrol. The victim at the first residence was identified as 53- year-old Michele Ebeling, according to the Nebraska State Patrol. As investigators arrived at the scene, a second fire was reported a few blocks away, authorities said. Three people were found dead in the second residence and fire crews worked to preserve evidence while putting out the fire, the state patrol said. A 42-year-old man was arrested Friday in connection with the four homicides early Thursday morning in Laurel, Nebraska, according to the state patrol.

Crime scene investigators found evidence that linked Jason Jones, a Laurel resident, to the homicides.

After attempts for Jones to exit the home voluntarily, the Nebraska State Patrol SWAT Team entered the home and found Jones with severe burn injuries, according to law enforcement. NSP said he was airlifted to a Lincoln hospital and is in serious condition as of Friday morning.

The Nebraska State Patrol also believes gunfire played a role in the deaths at two separate homes in the northeast Nebraska town.

Around 3 am, the Cedar County Sheriff’s Office responded to a call about an explosion at a residence in Laurel and fire teams found a person dead inside the home, according to the Nebraska State Patrol.

The victim at the first residence was identified as 53-year-old Michele Ebeling, according to the Nebraska State Patrol.

As investigators arrived at the scene, a second fire was reported a few blocks away, authorities said.

Three people were found dead in the second residence and fire crews worked to preserve evidence while putting out the fire, the state patrol said.
