Migrant caught masturbating in his car faces deportation, but his lawyer says the punishment doesn’t fit the crime

Two clinical psychologists have accused Community Corrections Tasmania of incorrectly applying a sexual offender risk assessment tool to determine whether or not a Nepalese man is likely to reoffend — and say the tool has likely been misused in other cases.

The man, who moved to Australia in 2015, faces being placed on the sex offenders register, which his lawyer says could lead to him being deported.

The 26-year-old Nepalese man was working as a food delivery driver in Hobart in 2021 when the offense occurred.

Hobart Magistrates Court heard earlier that on the day in question, the man had finished his early morning delivery shift and headed to Rosny Park.

Assuming no one was around, he began to masturbate in his car.

The court heard a council worker then approached the car to let the man know he could not park there. When he knocked on the window he realized the man was masturbating and the council worker told him to leave.

The man immediately drove away — he was later charged with one count of prohibited behavior to which he pleaded guilty.

As part of the court case, Community Corrections Tasmania (CCT) was asked to undertake a risk assessment to determine whether or not he was at risk of reoffending, which could then be used by the court to determine whether or not he should be placed on the sex offenders register.

CCT found he had a medium risk of reoffending.

That finding was challenged by the man’s lawyer, Dinesh Loganathan.

CCT ‘applying tool incorrectly’

Mr Loganathan commissioned reports from two separate clinical psychologists — Dr Grant Blake and Dr Emma Collins — who both refuted CCT’s assessment, finding the man had a very low-risk of reoffending.

Dr Blake even described the man’s risk of future offending as “far-fetched” and “fanciful”.

In court on Monday, Mr Loganathan told Magistrate Andrew McKee that despite the reports, CCT would not shift its position.

“We have two certified trained clinical psychologists who have provided a report to the court that Static-99R [the risk assessment tool] should have never been administered to [the man] and the administration was flawed,” he told the court.

“We have Community Corrections who have provided a recommendation that [he is at] medium risk of offending.

“On the other hand, there’s Dr Blake, who quite forcefully provides a view that Community Corrections has been wrongly administrating [assessments] for however long they’ve been doing it.”

Magistrate McKee then questioned the claim that CCT had “wrongly” administered assessments beyond the current case, to which Mr Loganathan responded by reading out some of Dr Blake’s report.

“Community Corrections must be informed they are continuing to use risk assessment tools incorrectly,” he read to the court.

“It is unethical, unacceptable practice. It cannot continue.”

Mr Loganathan said Dr Blake’s position was that the risk assessment should never have been applied to the man and CCT “continue to use it for people within Category B”.

The court heard Dr Collins’s report also stated it was wrong to use Static-99R to assess Category B offenders.

Tool developed by Canadian, UK researchers

According to the manual for Static-99R, Category B offenses include “sexting”, “consenting sex in public places” and “indecent behavior without a sexual motive”.

Static-99R was developed by researchers in Canada and the United Kingdom and is meant to apply in “cases where an actual sex offense has occurred with an identifiable victim”.

Community Corrections representative Emily Drysdale, who did not undertake the assessment, said it had been applied “based on the fact there had been sexual offending.”

“My communication with senior management is that it was correctly applied,” she told the court.

She said CCT did not have a position on whether or not the man should be placed on the register and that was up to the court.

When Magistrate McKee asked her if she accepted that the assessment had been applied incorrectly, Ms Drysdale deferred to her manager’s advice.

“In their understanding it was applied correctly,” she told the court.

Magistrate McKee said Community Corrections had assessed the man was at a “higher risk than a routine sample of offenders”.

“[Based on that] I would need to give significant consideration to the register,” he said.

When asked about what CCT thought of the psychologists’ opinions that the assessment tool was being used incorrectly, Ms Drysdale said she had passed on their feedback.

“I have submitted that to that particular manager and haven’t received a particularly favorable response,” she told the court.

While Ms Drysdale did not say that she was challenging the psychologists’ reports, Magistrate McKee said that by standing by CCT’s assertion it had applied the risk assessment tool correctly, she effectively was.

“Your manager has told you ‘we were right’, therefore, the only inference is that Dr Blake and Dr Collins are incorrect and I’ve got to sort it out,” he said.

The case has been adjourned and will potentially lead to a disputed facts hearing.

A computer expert who claims to have invented the digital currency Bitcoin has been awarded just £1 in damages after he gave ‘deliberately false’ evidence in a High Court defamation case.

Australian Dr Craig Wright, purportedly Bitcoin creator ‘Satoshi Nakamoto’, sued blogger Peter McCormack for libel over a series of tweets in 2019 that alleged his claim to be the enigmatic inventor was fraudulent.

In a ruling on Monday, Mr Justice Chamberlain concluded the tweets, and a video discussion broadcast on YouTube where Mr McCormack made similar claims, had caused ‘serious harm’ to Dr Wright’s reputation.

But the High Court judge limited Dr Wright’s damages to £1 after he put forward a ‘deliberately false’ case over being disinvited from academic conferences because of the tweets until days before the libel trial in May.

In the tweets made between March and August 2019, Mr McCormack, a podcaster specializing in content about cryptocurrencies, alleged that ‘Craig Wright is not Satoshi’ and is ‘a fraud’.

Amid complaints from Dr Wright’s solicitors, he tweeted in response: ‘Let’s go to court.’

In the lead-up to the libel trial, Dr Wright initially argued that he had been invited to speak at numerous conferences after the successful submission of academic papers for blind peer review, but that 10 invites were withdrawn following Mr McCormack’s tweets.

This included alleged potential appearances at events in France, Vietnam, the US, Canada and Portugal.

But Mr McCormack submitted evidence from academics challenging Dr Wright’s claims which were dropped from his case at the trial in May.

Dr Wright later accepted that some of his evidence was ‘wrong’ but that this was ‘inadvertent’, Mr Justice Chamberlain said.

The judge noted that there was ‘no documentary evidence’ that Dr Wright had a paper accepted at any of the conferences identified in the earlier version of his libel claim, nor that he received an invitation to speak at them except possibly one and nor that any invitation was withdrawn.

Dr Wright’s explanation for abandoning this part of his case because the alleged damage to his reputation from the ‘disinvitations’ was outside England and Wales ‘does not withstand scrutiny’, the judge added.

He concluded that ‘Dr Wright’s original case on serious harm, and the evidence supporting it, both of which were maintained until days before trial, were deliberately false’.

Lawyers for Mr McCormack argued at trial that his tweets were made in ‘flippant and light-hearted terms’ and were in response to posts by Calvin Ayre, a Canadian businessman, ‘goading others into accusing Dr Wright of being a fraud’.

They also claimed there were ‘numerous other individuals who had posted the same allegations about Dr Wright’, Mr Justice Chamberlain explained in his ruling.

Lawyers also ‘relied upon attempts by Dr Wright to sell the rights to his life story as showing that he had not been hurt by the controversy surrounding his claim to be Satoshi and indeed was trying to exploit that controversy for gain’, the judge said.

Mr Justice Chamberlain concluded that although the tweets were ‘flippant in tone’ they came from ‘a well-known podcaster and acknowledged expert in cryptocurrency’.

‘They were unequivocal in their meaning. Many people who read them would have known that there was a lively debate about whether Dr Wright was Satoshi, but some of them must have been influenced by reading Mr McCormack’s trenchantly expressed contribution to that debate,’ the judge continued.

‘The fact that he was willing to state his views so brazenly in response to threats of libel proceedings is likely to have made those who read them more, not less, likely to believe them.’

But the judge said that Dr Wright’s pre-trial case over the serious harm to his reputation made it ‘unconscionable’ that he should receive ‘any more than nominal damages’.

The judge said the identity of Satoshi Nakamoto was not an issue he had to determine in his ruling as Mr McCormack had earlier abandoned a defense of truth in his case.

CoinDesk reported that Dr Wright’s lawyers distributed a statement which read: ‘I intend to appeal the adverse findings of the judgment in which my evidence was clearly misunderstood.’

Rae suggests stepping in front of a mirror and having a proper look at your lips, and figuring out what you want to highlight with lipstick – as well as what you want to leave out.

As she tells Mia, “You want to keep your lips closed when you’re looking into the mirror to assess your lips.”

“Now, most of us, when we close, have these creases that continue out past your lip.”

The golden rule is to keep your lipstick away from these outer creases – because this will only drag the corner of your mouth down.

If you want to give yourself a guide, Rae suggests simply using your pinkie fingers to cover the outer corners of your lips.

Kalgoorlie sexual assaults: Man charged over home invasions, sex attacks

Police have charged a man over a spate over terrifying sex attacks in Kalgoorlie in the early hours of Monday morning.

In the space of two-and-a-half hours, between 1am and 3.30am, the man allegedly forced entry into three homes and at each property sexually or indecently assaulted an adult female. Police say he also unsuccessfully tried to gain entry to a fourth home.

All incidents were in the south Kalgoorlie-Boulder area. None of the homes or victims are linked.

On Monday, Superintendent Steve Thompson said as a result of police inquiries they arrested a man shortly before 7am.

“Our thoughts are with the victims of these incidents, which would have been a significant and traumatic event, and they’ve been provided with a medical and support that is appropriate,” Supt Thompson said.

Supt Thompson said the victims were aged between 30 and 70, with two of the women the only occupants of the houses at the time of the attacks but there was another occupant present during the incident in the third home.

He said entry was forced to the homes.

“It wasn’t a matter of an open door, there was force used,” he alleged.

Supt Thompson said police had responded quickly when the alarm was raised.

“We all come together, when it’s significant crimes such as this, we throw all available resources and we use all our capabilities. And, it’s very pleasing for me that within a matter of hours we were able to make an arrest,” he said.

“We’re fortunate to live in this State that incidents such as this . . . are very rare. And when they do occur, they are our highest priority and we throw all our resources at the investigation.”

A 30-year-old man from the Warburton community has been charged with two counts of aggravated sexual penetration without consent in the course of a home burglary, one count of indecent assault and three counts of home burglary.

He was refused bail and is due to appear in Kalgoorlie Magistrates Court on Tuesday.

Kentucky’s floods have been devastating. Timing is a key reason, an expert said

A historic deluge that battered eastern Kentucky last week was so devastating because it flooded the region when people were asleep — and because rainfall rates and locations are hard to pinpoint until the downpour happens, the state’s climatologist said.

“The biggest danger that came with this flooding is that most of the rain happened very quickly, very heavily, and overnight,” said Megan Schargorodski, who is also director of the Kentucky Climate Center at Western Kentucky University.

As of Monday, 37 people had died in the floods and “so many more” remain missing, Gov. Andy Beshear said.

Let us pray for these families and come together to wrap our arms around our fellow Kentuckians,” he said.

The geography of the region contributed to that devastation, with Appalachia’s complex terrain causing waterways and low-lying areas to quickly become inundated, Schargorodski said.

“Many routes get blocked due to flood waters and it can sometimes actually be more dangerous to evacuate,” she said.

Unlike mass evacuations that can happen days before a hurricane, she said, it’s less possible for people in eastern Kentucky to leave when they don’t know when and where the flooding will occur.

Nor are many in the region, with its soaring poverty rates, able to flee even if they wanted to, she said.

Still, Schargorodski said forecasters correctly anticipated significant rainfall across much of the eastern part of the state before the deluge.

Up-to-the-minute information was posted to social media by the National Weather Service and by Kentucky Emergency Management officials, who used Twitter and Facebook. Weather service offices in Kentucky, along with state emergency officials, began warning of flooding to come starting on July 25 at the latest.

Susan Buchanan, a spokeswoman for the National Weather Service, said in an email that its forecasts have been expanded to include not just what the weather will do, but how it will impact people.

The agency provides briefings to local officials, and forecasters often embed with emergency managers during weather events, Buchanan said.

“While we provide anticipated impacts, we do not provide advice for decision making,” she said.

Some of the hardest hit counties were not in the habit of communicating through social media, which could have left some residents without the latest information on the storm.

Kentucky Emergency Management lists “county directors” for local emergency services and links to local sites for more focused information. But in Knott County, where Gov. Andy Beshear said at least 15 people have died, the link leads to a page that “doesn’t exist.”

Its online presence includes a .com commercial page registered in Canada that has only an address and a phone number for “Emergency Management.” There are also third-party pages and sites, such as one hosted by countyoffice.org, with some county and emergency information.

The agency’s phone number did not appear to be working Monday, and a message sent to its Facebook page was not returned.

Efforts to reach the Knott County Sheriff’s Office were also unsuccessful.

Still, Missy Bush, a resident of Knott County, said that officials warned the community “through every avenue available to them.”

“They gave warnings about this system and flood chances, and many people were getting emergency alerts on their phones,” Bush, 40, said via Facebook messenger.

“But due to the time of night it started and how fast the water rose, many people in areas that had never before flooded saw water and went to gather a few things and leave,” she said.

They returned to a vehicle that was half underwater, she said.

“I really don’t know of any other warnings that would have helped,” she added.

In nearby Letcher County, Chloe Adams had no idea that flood warnings had been issued across a wide swath of her state.

Adams, 17, awoke at 5 am on Thursday to the sound of gurgling in her father’s double-wide trailer in Whitesburg and found dirty water bubbling up through every drain.

The water was quickly rising inside the trailer as Adams — who was home alone and whose father was at work in Lexington — tried to figure out an escape plan with her dog, an 11-year-old mutt named Sandy that she’d had for to decade

“All I know was that I only had two options here, we stay inside and drown or I take my chances swimming to safety,” she said in a text message to NBC News. “I knew the dangers of trying to swim in deep water but I felt I had no choice.”

She placed the dog and a sofa cushion in a plastic drawer and plunged into cold, fast moving water, hoping to make it to the roof of a nearby storage building.

“Somehow by the grace of God Sandy and I reached” it, she said.

They stayed there for several hours waiting to be rescued, she said. Eventually, she said, her cousin de ella arrived in a kayak and paddled the pair to safety.

Asked if authorities could have done more to alert her and others to the catastrophic flooding, she said that she believed authorities had done their jobs “perfectly.”

“They did all their warnings and news casts but I don’t watch the news and my phone was charging in another room when all the warnings went off,” she said. “Plus I was sleeping.”

New Toyota Land Cruiser Prado Matte Black Edition Launches In Japan

The Toyota Land Cruiser Prado soldiers on, and it’s now available in a new Matte Black Edition in Japan. This follows the 70th Anniversary Edition that launched last year, just before the new Land Cruiser debuted.

The new Matte Black Edition doesn’t add any performance upgrades, but it does spice up the SUV’s styling. Toyota adds matte black trim pieces all around, including the grille and grille insert, the fog light bezels, and the headlight garnish. The SUV also receives six-spoke 18-inch matte black aluminum wheels.

The updates aren’t significant as the aging SUV needs a significant overhaul. It’s smaller than the Land Cruiser, which entered a new generation last year and went on sale for the 2010 model year. The SUV market has significantly changed since then, and a new LC Prado could be on the horizon.

Toyota launched the all-new Land Cruiser LC300 last year, giving the model all-new underpinnings in the form of Toyota’s TNGA platform. The SUV received a major styling overhaul and a massively revamped interior that aligned the model with the rest of the SUV segment. We expect the Land Cruiser’s new platform to underpin the revamped Land Cruiser Prado whenever the updated version arrives.

The Land Cruiser Prado is exclusively available in either white or black. The new trim does not change the SUV’s powertrain, which appears to continue offering either the 201-horsepower (149-kilowatt) 2.8-liter diesel or the 163-hp (121 kW) 2.7-liter gasoline engine. Power hits all four wheels through a six-speed automatic gearbox.

Toyota is selling the Land Cruiser Prado Matte Black Edition for ¥4.3 to ¥5.1 million ($32,662 to $38,739 at today’s exchange rates). The Land Cruiser Prado is similar to the Lexus GX available in the US. It’s smaller than the standard Land Cruiser and designed to be a little less rugged than its full-blown sibling.

One of the most defining traits of the recent “Star Wars” series have been their extensive use of StageCraft, the ultra-HD ‘Volume’ video-wall technology that offers in-camera effects and immersive digital environments.

“The Mandalorian,” “The Book Of Boba Fett” and “Obi-Wan Kenobi” all utilized the technology heavily for a bunch of their sequences. The upcoming “Rogue One” prequel series “Andor” will not.

In fact, series creator and showrunner Tony Gilroy has surprisingly revealed to Empire the show didn’t touch it: “Yep, we’re old-school. We didn’t use StageCraft at all.”

This resulted in the building of massive sets at Pinewood along with plenty of location shooting with practical elements in an effort to capture a gritty texture in a dark and sinister time in the “Star Wars” universe.

On the one hand the actors loved some of it, star Diego Luna says: “As an actor, it’s beautiful. Everything is mechanical. You’re interacting with real stuff.” However, there were downsides, such as some Scottish locations that required hours of effort to reach setup certain shots.

One thing they did love, was the darker and more mature storytelling the show aims to offer, with Gilroy saying: “The freedom on this show was unprecedented. I’ve never had this level of trust, even with pictures I had final cut on.”

The show also isn’t afraid to get political. Gilroy says: “Sci-fi has always been an interesting way to talk about real issues. I didn’t come here to do the same old thing. There are refugee aspects to our series; there are political aspects. We have all the food groups.”

Actress Fiona Shaw, who plays Andor’s mother, says: “Tony has written a great, scurrilous [take] on the Trumpian world. Our world is exploding in different places right now, people’s rights are disappearing, and ‘Andor’ reflects that.”

Gilroy added he had “no interest” in “Star Wars” before he signed on for “Rogue One,” and his emotional detachment helped on that as it was a ‘doctoring job’. It also helps here as he says: “I wouldn’t be doing this if it wasn’t something that really interested me. Our goal with the show is ambitious but simple. We want to blow the hardcore ‘Star Wars’ people away. But we also want their husband, neighbor, sister – that person in their life who’s never gotten why they like ‘Star Wars.’ We’re absolutely going for both audiences.”

“Andor” is slated to premiere with three episodes on September 21st.
