Kevin Durant trade news, ultimatum to Joe Tsai, reaction, updates, Brooklyn Nets, Ben Simmons

Things got ugly for Ben Simmons in Philadelphia and if Kevin Durant is not careful, he could be heading down a similar path in Brooklyn — if he is not already.

But could that be all part of the Nets superstar’s master plan?

Well, Durant certainly got the NBA world talking earlier in the week then he issued an ultimatum that left Nets owner Joseph Tsai in a tricky situation.

Durant, who requested a trade in June, reportedly told Tsai he needs to choose between the 12-time All-Star and the pairing of head coach Steve Nash and GM Sean Marks.

A subsequent report from The New York Post laid out Durant’s specific grievances with the team, including a lack of consultation over the Nets’ firing of assistant coach and director of player development Adam Harrington.

But not everyone in the NBA world seems to think that Durant actually wants Nash or Marks fired from the organization.

That is certainly the opinion of Fox Sports’ Nick Wright, who said on ‘The Herd’ with Colin Cowherd that Durant’s ultimatum is all about achieving one “single goal”.

“I don’t think Kevin Durant actually wants those guys fired,” Wright said.

“I think he just wants to be traded. I think if he wanted Sean Marks and Steve Nash fired, he would have gone to Joe Tsai a month ago when he did the trade demand and quietly and privately said: ‘Listen, if you don’t fire these guys, I’m going to demand a trade’.

“I read this differently than most. I read this as Kevin Durant asking for something he knew he would not get in order to make it untenable for them to bring him back because he was starting to get concerned they were actually going to bring him back.

“This was him upping the ante to a level that is pretty unprecedented. It’s why I think Durant understood Joe Tsai is not going to do it and they also, I don’t believe, can ask Steve Nash to now coach Kevin Durant. I think it was a really smart move if his single goal is to be traded and I think that is his single goal.

You see, it is not like Durant has much leverage in this situation, as NBA front office insider John Hollinger explained in a recent article for The Athletic.

Hollinger pointed towards two numbers in particular to prove that point — 34 and four — Durant’s age and how many years he has left on his contract.

“Throwing both his coach and GM under the bus — in many cases for moves that came with a wink and nod from Durant’s camp — certainly makes it less likely the Nets will find it tenable to reunite everyone in the fall,” Hollinger wrote.

“Of course, this gambit offers no guarantees. The trade offers in front of the Nets today aren’t any different from the ones they rejected yesterday, and it’s not clear how or if Durant’s latest demand will compel action.”

What it could do though is lead to a similar situation to the one Simmons found himself in Philadelphia last year, although there are a few key differences as Hollinger also pointed out.

“Seemingly the sharpest arrow left in Durant’s quiver is pure hardball: a holdout, one that would cost him a chunk of his $44 million 2022-23 salary for every day he sat out,” he wrote.

“It would, ironically, be a near carbon-copy of the situation a year ago in Philadelphia with Durant’s occasional teammate Ben Simmons.

“Here’s the thing: The Nets are working on a different timeline than the Sixers were.”

Hollinger is right. Philadelphia had to move relatively fast to capitalize on Joel Embiid’s prime and as such was more inclined to reach a swift resolution in the Simmons drama.

The same cannot be said for the Nets though, as Hollinger argued.

“If anything, they would seem to have the opposite motivation,” he wrote.

“Yes, Brooklyn’s first choice would be to run it back with Durant, Simmons and Kyrie Irving (or a suitable replacement). But in the absence of Durant, wouldn’t the Nets’ second choice be to tank the season and try again in 2024? And wouldn’t a Durant holdout do anything more than accelerate the Nets toward that endgame?

“Brooklyn’s best-case scenario may be waiting until midseason, when this summer’s free agents are eligible to be dealt with. It seems less likely they’d let a year of Durant’s contract wither on the vine at his age and wait until next offseason… but it ca n’t totally be ruled out either given the tanking incentive.

What was consistent among a host of voices in the NBA media landscape was a sense of uncertainty, not knowing what exactly was coming next, again similar to the Simmons saga.

“The whole situation is a mess, but the kind of mess Brooklyn might happily sweep under a rug and ignore, if only it could,” The Ringers Rob Mahoney wrote.

“It’s impossible to replace Kevin Durant. Hell, it’s hard enough just to set a fair return for Durant in a trade, much less one suitors can realistically meet. Every ask sounds ridiculous because Durant is a genuinely ridiculous player.

“That might be the only reason he’s still a Net some six weeks after requesting a trade—and maybe the real reason KD is stirring the pot with this ultimatum in the first place. Does he really want Marks and Nash gone? Or is he just looking to send a shock through the Nets’ system?”

The Athletic’s Alex Schiffer, meanwhile, pointed towards Durant’s strong endorsement of Marks after the Brooklyn’s four-game sweep at the hands of Boston as proof of just how confusing it all is.

“If Durant wanted Nash out but didn’t feel like putting him on blast to the media 10 minutes after the season ended, he could have discussed Nash’s future with an ‘I don’t know’ or ‘Now’s not the time for that’ . But he didn’t,” Schiffer wrote.

Schiffer agreed one “plausible explanation” is that this is Durant trying to force Brooklyn’s hand, to make the situation so untenable that the Nets back down.

The Heat have been heavily linked to Durant since he first requested the trade but are unlikely to have the assets to make it work, at least in a traditional two-team deal.

The Miami Herald’s Anthony Chiang though Durant’s ultimatum was an important point in the drama, even if it still left “plenty of questions unanswered”.

“But in the wake of The Athletic’s report that Durant doesn’t want to work with Nash or Marks, the question is: Will this force the Nets to trade Durant prior to the start of training camp in late September to avoid any awkward tension and drama between the two parties? he wrote.

“That sort of deadline could take away some of the Nets’ leverage as the window to trade Durant before training camp shrinks as each day passes.

“The Nets could also decide to take Durant into training camp if a good enough offer doesn’t present itself, which would force Durant to decide whether to skip practices as he waits to be dealt or play through it.”

NBA insider Brian Windhorst though was not so sure it would pay off, should Durant’s ultimatum have been a ploy to try speed up a trade out of Brooklyn.

“Doing it now is a manoeuvre, a manoeuvre that I don’t think worked because as I talk to teams out there, they don’t think this increased his trade demand. They think this hurt his trade value,” Windhorst said on ‘NBA Today’.

Windhorst brought up Tsai’s tweet earlier in the week as proof of it, in which the Nets owner claimed: “Our front office and coaching staff have my support. We will make decisions in the best interest of the Brooklyn Nets.”

“I want to point to the second half of the Joe Tsai tweet,” Windhorst said.

“I think it’s obviously important to look at the first sentence which is that he’s not going to fire Sean Marks and Steve Nash. But the second sentence is really the sentence that the league paid attention to it. And it seems benign when he says ‘We make decisions for the best interest of the Brooklyn Nets.’

“But I’m going to decode that for you. What he’s basically saying is despite what Kevin Durant is trying to do here, we’re not going to change what our expectations are for a trade and if you are not traded, we expect you to be reporting to camp to continue the four years you have left on your contract.”

At this stage though, we are no closer to either party getting what they want, with Schiffer putting it best in his summation of the drama.

“During’s ultimatum,” he wrote, “opened a chest’s worth of questions while the clock to training camp continues to tick more loudly”.

Sewer emergency forces immediate shutdown of Provincetown restaurants, adds restrictions for residents

Provincetown declared a sewer emergency Thursday that calls for the immediate closure of restaurants in part of the town and places water restrictions on some residents.”We are declaring a sewer emergency for properties on the vacuum sewer system. This includes properties on Commercial Street from Snow Street to Point Street, and properties on the sewer system on Bradford Street between Conwell Street and Prince Street,” town officials said in a statement. Any restaurant or food service business in the service area must ease operations immediately. “This is necessary to prevent a further public health emergency caused by sewer overflows, and we need to drastically reduce flow to allow the critical repair work in order to get the town back to full capacity,” the town said.Any residential property on this system must reduce water use, including dishwashing, laundry, showering, and only flush when necessary. The emergency does not apply to sewer customers on the town’s gravity system, nor does it apply to properties with on-site septic systems. The town estimates that officials need up to 48 hours to make repairs and get the system back to normal. Cameron Smith smashed for ‘cowardly’ LIV Golf Series response, world view, reaction, video

Cameron Smith’s imminent defection is being viewed as the biggest “coup” to date for LIV in their quest for legitimacy.

Until now, The PGA Tour and its supporters could argue that the rebel league is merely a competition where washed up pros go to fill their bank accounts. No longer.

While tour veterans Phil Mickelson and Sergio Garcia were the initial names linked to the financially lucrative competition, the domino effect can’t be denied.

Brooks Koepka, Bryson DeChambeau and Dustin Johnson – three of the biggest names on the US PGA – have taken the money and left.

Smith’s signing however is being seen as a game-changer.

At 28, he is only now coming into the peak of his powers, he is the most recent major winner and he overran Rory McIlroy, the biggest name in world golf since Tiger Woods, to claim the Open Championship.

Nonetheless, Smith’s pending defection, which the Australian remained coy about ahead of the FedEx Cup playoff opener, hasn’t been filled with overwhelming excitement and a popping of corks.

Indeed, there’s an overarching sense of disappointment, inevitability and sadness about Smith’s likely defection; financial security has won over legacy and moral compass.

Writing for the UK Telegraph – the same publication that broke Smith’s defection on a deal worth more than $AU140 million – chiefs sports writer Oliver Brown emphasized that Smith’s defection “might” capture an audience that eventually garners a TV deal.

“His signing is arguably the Saudis’ most significant coup to date, and could represent a tipping point for the competition – a moment where a gilded freakshow turned into a sporting event which might demand the world’s attention,” Brown wrote.

At the heart of the appeal of LIV Golf, Brown hit the nail on his head when he revealed the ridiculous sums of money today’s stars were forgoing by resisting a move from the PGA Tour.

“Against this backdrop, you can see why the initial contact from Greg Norman, LIV’s ringmaster, became an offer Smith could not refuse,” he wrote.

“(Henrick) Stenson, a 46-year-old who has failed to reach the weekend in seven of his last nine majors, is the type of player he should be beating for breakfast. And yet the Swede, quickly forgetting his defenestration of him as Ryder Cup captain, earned more for a glorified three-day exhibition at Bedminster than Smith did for winning the 150th Open at the Home of Golf.

“From Smith’s perspective, this is an imbalance that urgently needs correcting. If he takes home the maximum loot of £3.93 million on his LIV debut in Boston next month, he would eclipse even the £2.98 million he earned at the Players Championship in May, in what was then the richest prize ever offered by a single golf tournament. Why should the leading man tolerate making less than some forgotten members of the chorus line?”

Brown continued by highlighting the ridiculous Saudi-funded money on offer but said the sheer financial sums couldn’t, at least at this point, match the theatre, drama and excitement on show at the PGA and DP World Tours.

“The numbers are so absurd, the golf itself has been rendered a sideshow. When Stenson holed the decisive putt at Bedminster, for the grandest payday of his career, the moment was greeted by the faintest rustle of polite applause. Even the winner himself did not look unduly bothered,” Brown wrote in The Telegraph.

“Here lies the sadness in Smith’s defection. With his talent in the fullest bloom, he deserves to be playing in front of the largest galleries, for the highest stakes. LIV ultimately offers him neither. It is a realm with all the money but none of the prestige. Smith, you sense, understands what true glory in golf means. As he gave his acceptance speech on the 18th green at St Andrews, the Claret Jug in his hand, the quaver in his voice suggested he was genuinely overwhelmed.

“For Smith to be swapping such moments for hollow, show-me-the-money exercises is a cause for lament. At one level, his departure from him in his prime from him demonstrates the scale of the Saudis’ ambitions. But at another, it is the grimmest possible reflection of the schism they have wrought.”

At the USATodayAndy Nesbitt, was far more scathing.

In particular, the publication took aim at Smith’s decision to deflect questions around his future and offer no definitive answer on whether he intended to shift allegiances.

“In doing so, (Smith) tarnished a reputation that just a few weeks ago was one of the best in professional golf,” Nesbitt wrote.

“Smith didn’t deny it and he didn’t confirm it, he just said he had “no comment” on that, which is a really lame way of ducking the question while also pretty much confirming the report to be true.”

Nesbitt went as far as saying his responses were “cowardly.”

“But to not come out with a definitive answer when asked about it before the start of the PGA Tour playoffs is a pretty cowardly thing to do.

“Now it’s a little harder to cheer for a guy who just a few weeks ago was the coolest golfer in the world.”

Thomas Kershaw from The Timestoo, wrote that Smith’s pending defection was the competition’s “biggest coup”.

“It has been very easy up until now to dismiss the gimmicks of LIV’s format — featuring shotgun starts, 54 holes and no cuts — as a watered-down exhibition lacking the essentials of elite competition. Critics could point to the players who shrugged off missed putts knowing their money was guaranteed beforehand and the rebel series was derived as a refuge for those who had cashed in on the twilight of their careers,” Kershaw wrote.

“The signing of Smith is a significant riposte to that narrative. LIV may already have a horde of relatively recent major champions but Bryson DeChambeau and Brooks Koepka have battled injuries and indifferent form while Phil Mickelson still seems a ghost of his former self. Smith, 28, is the first to defect who is not just at the peak of the game but still entering the prime of his own.

He continued: “Smith remains LIV’s biggest coup to date and also symbolizes another aspect of their revolt that could bring considerable success. Smith had been vocal in urging the PGA Tour to bring a major golf event back to Australia but while those calls fell on deaf ears, LIV — and Norman — have been only too keen to hear them. When LIV expands into a 14-tournament league next year, it is reportedly scheduled to stop in Sydney in April, where Smith is expected to feature in an all-Australian team.”

Closer to home, James Erskine, the former manager of the late Shane Warne, who also managed Greg Norman in the past, told The Sydney Morning Herald the emergence of LIV was “destabilizing”, but didn’t accept the argument that players had blood on their hands given the competition is being backed by Saudi Arabia.

“It’s destabilizing the fabric of professional golf. I’m on the board of the PGA of Australia and we have to look after all professionals and professionals coming up. They all start as amateurs somewhere and are nurtured through the pathway so they could play golf, and then they get cards and qualify professionally,” he said. “So many people do business with Saudi Arabia and the Middle East, where they have very different rules and regulations and different respect for women.

“But you can name just about any company and they will probably have a link to Saudi Arabia, Rolex, Range Rover, Rolls Royce, Ferrari. Everyone’s doing business with them, so I think it’s very unfair to turn around and say because you’re a professional golfer, you shouldn’t deal with Saudi Arabia.”

Meanwhile, Erskine said Smith would be welcomed to play in Australia even if he joins LIV Golf.

The Phoenix Suns and Miami Heat were initially listed as preferred landing spots for Kevin Durant but now two new contenders have emerged.

According to SNY’s Ian Begley, the Boston Celtics and Philadelphia 76ers are also desirable destinations for the 12-time All-Star.

Of course, Durant has been heavily linked to Boston in recent weeks, with a potential trade package centered around Jaylen Brown.

But those reports were focused on a move that would work for the Nets. This one looks at just what Durant may be after and it looks like he is keen on the Celtics too.

Boston reportedly offered Jaylen Brown, Derrick White, and a first-round pick but even that does not seem to be enough for Brooklyn, who want reigning Defensive Player of the Year Marcus Smart.

The Sixers, meanwhile, could offer an attractive package including Tyrese Maxey, Tobias Harris and/or Matisse Thybulle and would see Durant reunite with James Harden.

Durant would be likely to accept a trade to Boston of Philadelphia, though his Brooklyn future is likely in the hands of Joe Tsai.

The 12-time All-Star made an ultimatum to the Nets owner, asking for GM Sean Marks and coach Steve Nash to be fired or be shipped out of town himself.

Durant’s issues with the Nets and specifically Tsai go much deeper than his demand they fire Nash, a source close to the Nets and familiar with KD’s thinking told The New York Post.

“The ultimatum he made is not what really caused the deterioration. It’s not the ultimatum itself,” the source said.

Durant, among other things, was not consulted on the Nets’ firing of assistant coach and director of player development Adam Harrington when the season ended, the source believes.

“There are simple things that destroy a relationship. You fired someone he was close to and didn’t have a conversation about it,” the source said.

Last week, the popular Harrington attended a Liberty WNBA basketball game and was seen hugging current Nets players, according to a Reddit post.

“I would think there are so many things, it’s not one thing,” the source said. “I think KD wants to leave and it doesn’t matter what reasons he says.”

During a meeting this weekend with Tsai said, as he did last month, he wanted to be traded unless Nash was fired, The Post confirmed. There are also reports he wants general manager Sean Marks fired as well.

Marks was the main force behind hiring Nash, sources said.

Tsai, after the reports Monday about the meeting with Durant, tweeted, “Our front office and coaching staff have my support. We will make decisions in the best interest of the Brooklyn Nets.”

All involved recognize Marks and Nash do not have autonomy and ultimately if the Nets blow up it is because of Tsai, the source said.

Tsai now has to decide whether to lower his high asking price and get a Durant trade done before training camp opens at the end of September as the 33-year-old star has requested.

“I don’t think anybody on the team is safe from being traded. Everyone is up for grabs,” the source said.

Durant signed a four-year, $198 million contract extension in 2021, so he has limited power in forcing a trade unless he refuses to play. A source told The Post this week that’s an unlikely scenario.

“I don’t think he’s not going to play,” they said.

Ben Simmons responds to Brooklyn Nets group chat report, Maya Jama break-up

Ben Simmons isn’t naive to the rumors running rampant about his status with the Brooklyn Nets and his relationship with fiancee Maya Jama.

The Nets guard returned to Twitter on Wednesday, following a two-month hiatus, and tweeted, “slow news day”, with a crying-laughing emoji, the new york post reports.

Simmons also re-posted a tweet by Jama, in which the British TV presenter and model wrote “Stop believing ‘sources’ in papers plz”.

Jama’s tweet came Sunday, a day after reports emerged that she had allegedly called off the couple’s engagement and that the pair were “heartbroken” over the break-up.

Simmons’ tweet could have also been a response to a report from NBA insider Ric Bucher, who claimed the Aussie NBA star left a group chat without replying to Nets teammates who asked him to play in their must-win Game 4 of their playoff series against Boston last season. Brooklyn was swept by the Celtics in the first round.

“They’re having a team chat before Game 4, thinking he’s going to play against the Boston Celtics,” Bucher said on The Herd last week. “From what I’m told, Ben just left the chat.

“They asked him, ‘Are you going to play?’ Ben left the chat. Like he did n’t even answer the question, he just left the chat. And KD (Kevin Durant) is like, ‘This is what I signed up for? This is who I’m playing with?’”

on wednesday, The Athletic’s Shams Charania denied Bucher’s report during an appearance on The Pat McAfee Show.

“This never happened… it’s an amazing story but it didn’t happen,” said Charania.

Simmons also re-tweeted a clip of that exchange, suggesting once again he was bemused by suggestions of his text message etiquette.

A three-time All-Star, Simmons is currently training in New York and continuing recovery from back surgery he underwent in May.

“He’s looking good,” Charania said. “There are high expectations (in Brooklyn) for Simmons. He’s supposed to be ready for training camp … and he’s doing more and more on the court.”

Simmons sat out the entire 2021-22 NBA season due to mental health issues and a lingering back injury, including the first half of the season with the Sixers, and then the remainder of the season after Philadelphia traded him to the Nets for James Harden in February.

Simmons’ latest tweet also came a day after The New York Post confirmed that Durant — who requested a trade out of Brooklyn in June — wants General Manager Sean Marks and head coach Steve Nash gone.

On Monday, The Post confirmed Durant issued an ultimatum to Nets owner Joe Tsai at a face-to-face meeting in London, telling Tsai to choose between him or Marks and Nash.

Judge denies restraining order for Matt Jones, Talor Gooch and Hudson Swafford, FedEx Cup Playoffs

A federal judge has denied a request by three LIV Golf Series players, including Australian Matt Jones, for a temporary restraining order allowing them to play in this week’s $US75m PGA Tour FedEx Cup playoffs.

US District Court Judge Beth Labson Freeman made the ruling after a hearing at San Jose on the lawsuit filed in the Northern District of California. The news came on a dramatic day in which Aussie world No.2 Cameron Smith was reported to have signed on for the Greg Norman-led rebel tour.

Jones and Americans Talor Gooch and Hudson Swafford had sought the chance to compete in the FedEx Cup playoff opener, the St. Jude’s Championship, that begins Thursday in Memphis.

All three were among those suspended by the PGA Tour after they teed off in their first event of the Saudi-backed LIV Golf Series in June. The ruling upheld that ban.

“We’re disappointed that Talor Gooch, Hudson Swafford and Matt Jones won’t be allowed to play golf,” LIV Golf said in a statement. “No one gains by banning golfers from playing.” Gooch was ranked 20th in FedEx Cup points with Jones 65th and Swafford 67th. The top 125 players in season points qualified for Memphis with 70 players advancing to next week’s BMW Championship and the top 30 reaching the season-ending Tour Championship in Atlanta.

Had they been able to play and reached the Tour Championship, the trio would have earned berths in next year’s Masters and US and British Opens.

But LIV Golf players could not show irreparable harm since they will be allowed to play LIV Golf events when those resume next month in Boston.

While LIV Golf players claim they are independent contractors, the PGA Tour argued they were members and the tour can punish members who violate rules, such as playing in LIV events.

“With today’s news, our players, fans and partners can now focus on what really matters over the next three weeks, the best players in the world competing in the FedEx Cup playoffs,” PGA Tour commissioner Jay Monahan said in a memo obtained by The GolfChannel.

LIV Golf has lured away such top stars as Dustin Johnson and Henrik Stenson with guaranteed money and record purses of $25 million at events.

Jones, Gooch and Swafford were among 11 LIV Golf players who filed an anti-trust lawsuit against the PGA Tour.

Mexico’s Carlos Ortiz, who had been among the 11 players in the lawsuit, has dropped out of the case, his manager said.

Some players at Memphis warned of a frosty reception for LIV golfers had they been allowed to tee off after departing for richer prize money as well as trying to knock PGA players out of their own playoffs.

“Going to be a pretty icy Thursday morning if those guys play,” 2009 US Open champion Lucas Glover told The Golf Channel. “They want their cake and eat it too.”

CONCORD, NH (AP) — A jury on Tuesday acquired a commercial truck driver of causing the deaths of seven motorcyclists in a horrific head-on collision in northern New Hampshire that exposed fatal flaws in the processing of license revocations across states.

Volodymyr Zhukovskyy, 26, of West Springfield, Massachusetts, was found innocent on seven counts of manslaughter, seven counts of negligent homicide and one count of reckless conduct in connection with the June 21, 2019, crash in Randolph. Jailed since the crash, he appeared to wipe away tears as the verdict was read and briefly raised his index finger skyward before leaving the courtroom.

Jurors deliberated for less than three hours after a two-week trial during which prosecutors argued that Zhukovskyy — who had taken heroin, fentanyl and cocaine earlier on the day of the crash — repeatedly swerved back and forth before the collision and told police he caused it. But a judge dismissed eight charges related to whether he was impaired, and his attorneys blamed the lead biker, Albert “Woody” Mazza Jr., saying he was drunk and not looking where he was going when he lost control of his motorcycle and slid in front of Zhukovskyy’s truck.

“Our hearts go out to the victims and their families. Our trial team did an excellent job and we firmly believe that the State provided its case beyond a reasonable doubt,” New Hampshire Attorney General John Formella said in a statement.

Zhukovskyy’s family, some of whom attended the trial, said in a statement they were grateful to God, the court and the defense attorneys for an “honest and fair trial.”

“Our family expresses its deepest condolences to the family and friends affected by this tragedy,” the family said, describing him as a “very honest and kind man. He would never have done anything to hurt anyone.”

Zhukovskyy, who was born in Ukraine, remained jailed as of late Tuesday afternoon. It is unclear when he might be released. US Immigration and Customs Enforcement issued an immigration detainer on him after the crash and that he was executed following the verdict, said Ben Champagne, the superintendent at the Coos County Department of Corrections.

ICE said in a statement that Zhukovskyy has been served a notice to appear before an immigration judge and will remain in ICE custody pending the outcome of that appearance. It did not say where he is being held.

All seven motorcyclists killed were members of the Jarheads Motorcycle Club. After the verdict, a member of the Marine group reached through Facebook declined to comment. Mazza’s father, also named Albert, said he was stunned.

“Killing seven people and he gets off. That is unbelievable,” said Mazza. He described his son of him as a “good man” who devoted much of his time to charity, and said it was wrong to pin blame on him.

“It doesn’t make much sense,” he said. “There are seven people dead. There are seven families affected. It’s strange that he didn’t get something.”

The motorcyclists who died were from New Hampshire, Massachusetts and Rhode Island and ranged in age from 42 to 62. They were part of a larger group that had just left a motel along US Route 2 in Randolph.

Killed were Mazza, of Lee, New Hampshire; Edward and Jo-Ann Corr, a couple from Lakeville, Massachusetts; Michael Ferazzi, of Contocook, New Hampshire; Desma Oakes, of Concord, New Hampshire; Daniel Pereira, of Riverside, Rhode Island; and Aaron Perry, of Farmington, New Hampshire.

In closing statements Tuesday morning, the two sides raised questions about who was more “all over the place”: the trucker accused of swerving back and forth across the road or the eyewitnesses accused of contradicting each other.

“Those witnesses were all over the place about what they recalled and what they claimed to have seen,” said defense attorney Jay Duguay.

Duguay also accused prosecutors of ignoring that their own accident reconstruction unit contradicted their theory that Zhukovskyy crossed into the oncoming lane. An expert hired by the defense, meanwhile, testified that the crash happened on the center line of the road and would have occurred even if the truck was in the middle of its lane because Mazza’s motorcycle was heading in that direction.

“From the beginning of this investigation, the state had made up their mind about what had happened, evidence was damned,” said Duguay, who also highlighted inconsistencies between witness accounts or when witnesses contradicted themselves.

In particular, Duguay suggested that the bikers “shaded” their accounts to protect Mazza and the club. Prosecutor Scott Chase acknowledged some inconsistencies, but asked jurors to remember the circumstances.

“People were covering the dead, trying to save the barely living, comforting the dying. This wasn’t story time,” he said. “They were up here talking about some of the most unimaginable chaos, trauma, death and carnage that we can even imagine three years later. They were talking about hell broke open.”

Witnesses were consistent, he argued, in describing the truck as weaving back and forth before the crash. That behavior continued “until he killed people,” Chase said.

“That’s what stopped him. It’s not that he made some responsible decision to start paying attention or do the right thing,” he said. “The only thing that stopped him was an embankment after he tore through a group of motorcycles.”

Chase called the attempt to blame Mazza a “fanciful story” and “frivolous distraction,” while reminding jurors that Zhukovskyy, who didn’t testify at trial, told investigators “Obviously, I caused the crash.”

“He was crystal clear from the very beginning that he caused this crash,” Chase said. “That is what he said, because that is what happened.”

Zhukovskyy’s commercial driving license should have been revoked in Massachusetts at the time of the crash because of a drunken driving arrest in Connecticut about two months earlier.

Connecticut officials alerted the Massachusetts Registry of Motor Vehicles, but Zhukovskyy’s license wasn’t suspended due to a backlog of out-of-state notifications about driving offenses. In a review, federal investigators found similar backlog problems in Rhode Island, New Hampshire and at least six other jurisdictions.

The Nets superstar issued an ultimatum to Joe Tsai over the weekend that the team owner needs to choose between Durant and the pairing of head coach Steve Nash and GM Sean Marks, The Athletic reported Tuesday (AEST).

Durant, who requested a trade in June and has not been moved, had a face-to-face meeting with Tsai in London in which he did not rescind his demand.

According to the report, the Nets have “direct knowledge” concerning why the 12-time All-Star has asked out a year after he signed a four-year, $198 million extension.

The Nets have not found a trade offer that could satisfy losing the all-time great, and according to the report, Tsai and the Nets have made it known they will take “every last asset from a team that trades for Durant.”

In stating the lofty hope for the trade return, perhaps the Nets think Durant would be less motivated to leave.

The Nets are coming off a chaotic and wildly disappointing season in which the unvaccinated Kyrie Irving was banned until December and then primarily could only play in road games; James Harden, dealing with a heavier burden without Irving, requested a trade and was flipped for Ben Simmons, who never actually stepped foot on the court; and Brooklyn eventually was swept out of the first round by the Celtics.

In the aftermath, Marks said the team culture “isn’t what it quite was” and said it was his and Nash’s “job to pick that up.”

Durant reportedly does not want the GM and coach combination to be able to follow through.

After the Game 4 loss to Boston, Durant expressed his appreciation for Nash and said he was the right coach to lead the Nets into the future.

“Steve’s been dealt a crazy hand the last two years,” Durant said.

“He’s had to deal with so much stuff as a head coach, a first-time coach. Trades, injuries, COVID and just a lot of stuff he had to deal with.

“I’m proud of how he’s focused and his passion for us. We all continue to keep developing over the summer and see what happens.”

Mass. woman stabbed to death by grand nephew in Lowell, DA says

A Massachusetts man is facing a murder charge in connection with the stabbing death of his great aunt in Lowell, according to authorities. The Middlesex District Attorney’s Office announced Sunday that 22-year-old Rayshawn Settles, of Lowell, was arrested Saturday without incident at the Saint’s Campus of Lowell General Hospital. Settles had been civilly held at the hospital since Aug. 1. According to the DA’s Office, surveillance video and DNA evidence tied Settles to the July 31 death of 64-year-old Linda Gilbert, also of Lowell. On July 31, Lowell police responded to a house on Loring Street shortly before 11:20 pm Sunday after receiving reports of an unresponsive woman inside. Gilbert was found inside the home with apparent trauma and transported to Lowell General Hospital, where she was pronounced dead. The state’s Office of the Chief Medical Examiner ruled Gilbert’s death de ella to be a homicide and that the cause of her death de ella was multiple stab wounds. Authorities said investigators were able to find surveillance video of Settles, Gilbert’s grand-nephew, walking to and from the Loring Street home around the time of the murder. Investigators were also able to find clothing Settles allegedly wore during the murder. Testing at the Massachusetts State Police Crime Laboratory found that those clothes had Gilbert’s DNA on them. Settles is expected to be arraigned Monday in Lowell District Court. The case was investigated by the Middlesex District Attorney’s Office, state police detectives assigned to the DA’s Office and Lowell police.
