Biden steps out of the room and finds legacy-defining wins

WASHINGTON (AP) — Over five decades in Washington, Joe Biden knew that the way to influence was to be in the room where it happens. But in the second year of his presidency, some of Biden’s most striking, legacy-defining legislative victories came about by staying out of it.

A summer lawmaking blitz has sent bipartisan bills addressing gun violence and boosting the nation’s high-tech manufacturing sector to Biden’s desk, and the president is now on the cusp of securing what he called the “final piece” of his economic agenda with the sudden resurrection of a Democrats-only climate and prescription drug deal. And in a counterintuitive turn for the president who has long promoted his decades of Capitol Hill experience, Biden’s aides chalk up his victories to the fact that he’s been publicly playing the role of cheerleader rather than legislative quarterback.

“In a 50-50 Senate, it’s just true that when the White House takes ownership over a topic, it scares off a lot of Republicans,” said Sen. Chris Murphy, D-Conn. “I think all of this is purposeful. When you step back and let Congress lead, and then apply pressure and help at the right times, it can be a much more effective strategy to get things done.”

Democrats and the White House hope the run of legislative victories, both bipartisan and not, just four months before the November elections will help resuscitate their political fortunes by showing voters what they can accomplish with even the slimmest of majorities.

Biden opened 2022 with his legislative agenda at a standstill, poll numbers on the decline and a candid admission that he had made a “mistake” in how he carried himself in the role.

“The public doesn’t want me to be the ‘President-Senator,’” he said. “They want me to be the president and let senators be senators.”

Letting the senators be senators was no easy task for Biden, whose political and personal identities are rooted in his formative years spent in that chamber. He spent 36 years as a senator from Delaware, and eight more as the Senate’s president when he was valued for his Capitol Hill relationships and insights from him as Barack Obama’s vice president.

As Biden took a step back, he left it to aides to do much of the direct negotiating. His legislative strategy, instead, focused more on using his role as president to provide strategic jolts of urgency for his agenda both with lawmakers and voters.

In the estimation of many of his aides and advisers, leaving the Senate behind was key to his subsequent success. The heightened expectations for Democrats, who hold precarious majorities in Congress but nonetheless have unified control of Washington, were dragging Biden down among his supporters of him who wanted more ambitious action.

The sometimes unsavory horse-trading required to win consensus often put the president deep in the weeds and short on inspiration. And the dramatic negotiating breakdowns on the way to an ultimate deal proved to be all the more tantalizing because Biden himself was a party to the talks.

In the spring of 2021, Biden made a big show of negotiating directly with Sen. Shelley Moore Capito, RW.Va., on an infrastructure bill, only to have the talks collapse over the scope of the package and how to finance it. At the same time, a separate bipartisan group had been quietly meeting on its own, discussing how to overhaul the nation’s transportation, water and broadband systems. After the White House gave initial approval and then settled the final details with senators, that became the version that was shepherded into law.

The president next tried to strike a deal on a sweeping social spending and climate package with Sen. Joe Manchin, going as far as inviting the West Virginia lawmaker to his home in Wilmington, Delawareuntil the conservative Democrat abruptly pulled the plug on the talks in a Fox News interview. Manchin would later pick up the negotiations again, this time with just Senate Majority Leader Chuck Schumer, DN.Y., and the two would eventually reach an agreement that is now on the verge of Senate approval after more than a year of legislative wrangling.

In late 2021, White House aides persuaded the president to clamor up about his conversations with the Hill, as part of a deliberate shift to move negotiations on his legislative agenda out of the public eye. The West Wing, once swift with the news that Biden had called this lawmaker or invited that caucus to the White House for a meeting, kept silent.

The new approach drew criticism from the press, but the White House wagered that the public was not invested in the details and would reward the outcomes.

Biden and his team “have been using the bully pulpit and closely working with Congress to fight for policies that lower costs for families and fight inflation, strengthen our competitiveness versus China, act against gun violence” and help veterans, said White House spokesman Andrew Bates . “He also directed his Cabinet, senior staff and legislative team to constantly engage with key lawmakers as we work together to achieve what could soon be the most productive legislative record of any president” since Lyndon Johnson.

Some of the shift, White House aides said, also reflected the changing dynamics of the COVID-19 pandemic, which kept Biden in Washington for most of 2021; his meetings of him with lawmakers amounted to one of the few ways to show he was working. As the pandemic eased and Biden was able to return to holding more in-person events with voters and interest groups, he was able to use those settings to drive his message directly to people.

The subtle transformation did not immediately pay dividends: Biden’s approval rating only continued to slide amid legislative inertia and soaring inflation.

Yet in time, Biden’s decision to embrace a facilitating role rather than being a negotiator in chief — which had achieved mixed success — began to pay off: the first substantive gun restrictions in nearly three decades, a measure to boost domestic production of semiconductor computer chips, and care for veterans exposed to toxic burn pits.

White House officials credit Biden’s emotional speech after the school shooting in Uvalde, Texas, with helping to galvanize lawmakers to act on gun violence — and even his push for more extensive measures than made it into the bill with giving the GOP space to reach a compromise. And they point to a steady cadence of speeches over months emphasizing the need to lower prescription drug costs or to act on climate with keeping those issues in the national conversation amid the legislative fits and starts.

In turn, both Democratic and GOP lawmakers say that Biden removing himself directly from the negotiations empowered senators to reach consensus among themselves, without the distraction of a White House that may have repeatedly pushed for something that would be unattainable with Republicans or could be viewed as compromising by some Democrats.

“The president kind of had said that we’re staying out,” Sen. Rob Portman, R-Ohio, said, referring to the gun talks earlier this year. “I think that was helpful.”

Being hands off, however, by no means meant the administration was absent.

Rather than be in the room as a gun deal was coming together, White House aides stayed by the phone, explaining how the administration would likely interpret and regulate the law that senators were drafting. Murphy spoke with White House officials every day, and when the Connecticut senator met personally with Biden in early June to offer an update, the president never gave him an ultimatum on what he was or was not willing to sign — continuing to defer to lawmakers.

At another point during the gun negotiations, rumors flew that the administration was considering barring the Pentagon from selling certain types of surplus ammunition to gun dealers, who then sold the ammunition commercially, according to two people familiar with the deliberations. But Republicans, chiefly Sen. John Cornyn, R-Texas, urged the White House to scrap those plans because it would run counter to the parameters of what the gun negotiators had discussed, said the people, who spoke on condition of anonymity to discuss details of private negotiations.

The White House eventually did so, issuing a statement to a conservative publication that no such executive order on ammunition was under consideration.

On the semiconductor package that Biden plans to sign into law Tuesday, the administration organized classified briefings for lawmakers that emphasized how China is gaining influence in the computer chip sector and the national security implications. Republicans were regularly in touch with Commerce Secretary Gina Raimondo, a Biden Cabinet official who has developed warm relationships across the aisle.

And on the Democrats’ party-line climate and health care package, Manchin has emphasized that it is impossible to craft legislation of this magnitude without White House input, although he did not deal with Biden directly until near the end, when the president called to let Manchin know the White House would support his agreement with Schumer, according to an official with knowledge of the call.

Biden also stayed out of the last-minute deliberations involving Sen. Kyrsten Sinema, D-Ariz., and she and the president did not speak even as Democrats finalized an agreement that accommodated her demands.

“In his heart, Joe is a US senator,” said Sen. Jon Tester, D-Mont., the chief Democratic author of the burn pits legislation who also helped hash out the infrastructure law last year. “So he understands allowing this to work is how you get it done.”

Alex Jones ordered to pay $45.2M more over Sandy Hook lies

AUSTIN, Texas (AP) — A Texas jury on Friday ordered conspiracy theorist Alex Jones to pay $45.2 million in punitive damages to the parents of a child who was killed in the Sandy Hook Elementary School massacre, adding to the $4.1 million he must pay for the suffering he put them through by claiming for years that the nation’s deadliest school shooting was a hoax.

The total — $49.3 million — is less than the $150 million sought by Neil Heslin and Scarlett Lewis, whose 6-year-old son Jesse Lewis was among the 20 children and six educators killed in the 2012 attack in Newtown, Connecticut. But the trial marks the first time Jones has been held financially liable for peddling lies about the massacre, claiming it was orchestrated by the government to tighten gun laws.

Afterward, Lewis said that Jones — who wasn’t in the courtroom to hear the verdict — has been held accountable. She said when she took the stand and looked Jones in the eye, she thought of her son de ella, who was credited with saving lives by yelling “run” when the killer paused in his rampage.

“He stood up to the bully Adam Lanza and saved nine of his classmates’ lives,” Lewis said. “I hope that I did that incredible courage justice when I was able to confront Alex Jones, who is also a bully. I hope that he inspires other people to do the same.”

It could be a while before the plaintiffs collect anything. Jones’ lead attorney, Andino Reynal, told the judge he will appeal and ask the courts to drastically reduce the size of the verdict.

After the hearing, Reynal said he thinks the punitive amount will be reduced to as little as $1.5 million.

‘We think the verdict was too high. … Alex Jones will be on the air today, he’ll be on the air tomorrow, he’ll be on the air next week. He’s going to keep doing his job holding the power structure accountable.”

Jones’ companies and personal wealth could also get carved up by other lawsuits and bankruptcy. Another defamation lawsuit against Jones by a Sandy Hook family is set to start pretrial hearings in the same Austin court on Sept. 14. He faces yet another defamation lawsuit in Connecticut.

Plaintiffs’ attorney Mark Bankston said he believes he can challenge any attempt to reduce the damages. But he said even if the award is drastically cut, it’s just as important to take the big verdict into the bankruptcy court for the family to claim against Jones’ estate and company.

Jones testified this week that any award over $2 million would “sink us.” His company Free Speech Systems, which is Infowars’ Austin-based parent company, filed for bankruptcy protection during the first week of the trial.

Punitive damages are meant to punish defendants for particularly egregious conduct, beyond monetary compensation awarded to the individuals they hurt. A high punitive award is also seen as a chance for jurors to send a wider societal message and a way to detect others from the same abhorrent conduct in the future.

Barry Covert, a Buffalo, New York, First Amendment lawyer with no connection to the Jones case, said the total damages awarded amount to “a stunning loss for Jones.”

“With $50 million in all, the jury has sent a huge, loud message that this behavior will not be tolerated,” Covert said. “Everyone with a show like this who knowingly tells lies—juries will not tolerate it.”

Future jurors in other pending Sandy Hook trials could see the damage amounts in this case as a benchmark, Covert said. If other juries do, Covert said, “it could very well put Jones out of business.”

Attorneys for the family had urged jurors to hand down a financial punishment that would force Infowars to shut down.

“You have the ability to stop this man from ever doing it again,” Wesley Ball, an attorney for the parents, told the jury Friday. “Send the message to those who desire to do the same: Speech is free. Lies, you pay for.”

An economist testified that Jones and the company are worth up to $270 million.

Bernard Pettingill, who was hired by the plaintiffs to study Jones’ net worth, said records show that Jones withdrew $62 million for himself in 2021, when default judgments were issued in lawsuits against him.

“That number represents, in my opinion, a value of a net worth,” Pettingill said. “He’s got money put in a bank account somewhere.”

But Jones’ lawyers said their client had already learned his lesson. They argued for a punitive amount of less than $300,000.

“You’ve already sent a message. A message for the first time to a talk show host, to all talk show hosts, that their standard of care has to change,” Reynal said.

Friday’s damages drew praise from the American Federation of Teachers union, which represented the teachers at Sandy Hook.

“Nothing will ever fix the pain of losing a child, or of watching that tragedy denied for political reasons. But I’m glad the parents of Sandy Hook have gotten some justice,” union President Randi Weingarten said in a tweet.

Lawyers for the Sandy Hook families suing Jones contend he has tried to hide evidence of his true wealth in various shell companies.

During his testimony, Jones was confronted with a memo from one of his business managers outlining a single day’s gross revenue of $800,000 from selling vitamin supplements and other products through his website, which would approach nearly $300 million in a year. Jones called it a record sales day.

Jones, who has portrayed the lawsuit as an attack on his First Amendment rights, granted during the trial that the attack was “100% real” and that he was wrong to have lied about it. But Heslin and Lewis told jurors that an apology wouldn’t suffice and called on them to make Jones pay for the years of suffering he has put them and other Sandy Hook families through.

The parents told jurors they’ve endured a decade of trauma, first inflicted by the murder of their son and what followed: gunshots fired at a home, online and phone threats, and harassment on the street by strangers. They said the threats and harassment were all fueled by Jones and his conspiracy theory spread to his followers via Infowars.

A forensic psychiatrist testified that the parents suffer from “complex post-traumatic stress disorder” inflicted by ongoing trauma, similar to what might be experienced by a soldier at war or a child abuse victim.

Throughout the trial, Jones was his typically bombastic self, talking about conspiracies on the witness stand, during impromptu news conferences and on his show. His erratic behavior by him is unusual by courtroom standards, and the judge scolded him, telling him at one point: “This is not your show.”

The trial drew attention from outside Austin as well.

Bankston told the court Thursday that the US House committee investigating the Jan. 6, 2021, insurrection at the US Capitol has requested records from Jones’ phone that Jones’ attorneys had mistakenly turned over to the plaintiffs. Bankston later said he planned to comply with the committee’s request.

By Friday, Bankston said, he had “a subpoena sitting on my desk’ from the Jan. 6 committee. But he said he needed to “tamp down expectations” that it might reveal texts about the insurrection since it appears to have been scraped for data in mid-2020.

Bankston said he’s also had “law enforcement” interest in the phone data, but he declined to elaborate.

Last month, the House committee showed graphic and violent text messages and played videos of right-wing figures, including Jones, and others vowing that Jan. 6 would be the day they would fight for Trump.

The committee first subpoenaed Jones in Novemberdemanding a deposition and documents related to his efforts to spread misinformation about the 2020 election and a rally on the day of the attack.

Primaries bring big losses for incumbent GOP state lawmakers

MADISON, Wis. (AP) — As Wisconsin’s longest-serving Assembly speaker, Republican Robin Vos has presided over efforts to restrict abortions, weaken unions, expand gun rights and push back against COVID-19 mandates. Despite that, he’s facing a primary challenger who claims he’s not conservative enough.

The challenger’s argument: You should do more to respond to former President Donald Trump’s unfounded allegations of fraud in the 2020 elections.

Primary challengers like the one facing Vos next Tuesday have been successfully targeting incumbent state lawmakers across the country, and Republicans are taking the brunt of it.

With more than half the state legislative primaries concluded, Republican incumbents this year have been losing at nearly twice the average rate of the past decade, according to data compiled for The Associated Press by the election tracking organization Ballotpedia. The primary loss rate for Democratic state lawmakers is similar to previous elections.

The Republican losses continued to mount Tuesday, as Trump-endorsed candidates You incumbent state senators in Arizona and Michigan and a conservative challenger beat the assistant majority leader of the Missouri Senate. Though not technically an incumbent, Arizona House Speaker Rusty Bowers also lost a bid for state Senate after being criticized for refusing to help Trump’s efforts to overturn the 2020 election.

In many cases, Republican lawmakers are being defeated by challengers portraying themselves as more conservative on election integrity, transgender policiesschool instruction and other hot-button issues.

“We have a far-right faction that is very dissatisfied with what’s happening on the left. So if you are not rabidly a fanatic that just punches every button, then you’re going to have an issue,” said Arkansas state Rep. Craig Christiansen, who lost in a Republican primary earlier this year.

Though Christiansen considers himself “very conservative,” he drew multiple challengers and failed to advance to a runoff. That came after he voted against overriding Republican Gov. Asa Hutchinson’s veto of legislation making Arkansas the first state banning gender-confirming treatments for those younger than 18. Christiansen said he considered the legislation unconstitutionalbecause it lacked an exception for youths already undergoing such treatments.

Vos, who has served as Wisconsin Assembly speaker since 2013, has taken sharp criticism for not pursuing a resolution decertifying Democrat Joe Biden’s victory in the state. trump endorsed his Republican challenger, Adam Steen, saying that “Vos refused to do anything to right the wrongs that were done” in the 2020 election.

Under pressure from Trump, Vos hired former state Supreme Court Justice Michael Gableman last year to investigate the election. Gableman said decertifying the election was “a practical impossibility.”

Steen said he decided to challenge Vos because he failed to pass legislation outlawing absentee ballot drop boxes ahead of the 2020 election and hasn’t pushed for tougher consequences for voter fraudamong other things.

“Conservatism as a whole has been lethargic,” Steen said. “We lack vision, and I think that vision is coming back.”

Vos said Steen is running on hyperbole. He said Gov. Tony Evers, a Democrat, poses the real obstacle to conservatives. Evers, for example, vetoed Republican bills that would have made it harder to vote absentee.

“If we don’t get a Republican governor, (Steen) would have less success than I had,” Vos said.

You are one of nine GOP Wisconsin lawmakers facing primaries. Though the challengers face an uphill fight, they could push the already conservative Legislature even further right if they notch a few victories. That would mark a significant shift in a state that plays a crucial role in national elections.

Twenty-seven states had held legislative primaries or conventions before Tuesday. In those, at least 110 Republican incumbents and 33 Democrats had been defeated. The Republican loss rate of 7.1% far exceeds the Democratic rate of 2.8%. It also significantly exceeds the 3.6% average Republican incumbent loss rate over the previous decade in those states, as well as the 4.4% Republican loss rate in those states during the last redistricting election cycle in 2012.

Idaho voters have led the way in ousting Republican incumbents, defeating 18 GOP lawmakers — or 30% of those who sought reelection — even while choosing GOP Gov. Brad Little over a Trump-backed challenger who claimed he wasn’t conservative enough. The losers included three lawmakers representing Kootenai County in northern Idaho, where a local Republican committee recommended conservative challengers against some incumbents after a lengthy vetting process.

“People have kind of had it, and they’re willing to get up and vote,” said Brent Regan, chair of the Kootenai County Republican Central Committee.

In Iowa, Republican Gov. Kim Reynolds endorsed primary opponents to four GOP state House members who hadn’t supported her plan to provide taxpayer-funded scholarships for students to attend private schools. All four incumbents lost, including House Education Committee Chairman Dustin Hite.

Even in some Democratic-dominated states, Republican primary voters have ousted incumbents deemed not conservative enough.

Illinois state Rep. David Welter, one of nine Republican lawmakers booted from the chamber in February for ignoring COVID-19 protocols to wear masks, lost his primary in June to a challenger who claimed Welter wasn’t Republican enough. Challenger Jed Davis criticized Welter’s votes for the Equal Rights Amendment and a construction bill containing a gas tax hikeamong other things.

Davis also derived Welter’s connections to US Rep. Adam Kinzinger of Illinois, who became a GOP outcast after voting to impeach Trump and participating in the Democratic-led House panel investigating the Jan. 6, 2021, attack on the US Capitol. Welter eleven worked for Kinzinger’s campaign and received $32,500 in contributions since 2021 from committees associated with Kinzinger.

“People pegged me as more of a moderate,” Welter said. “I’m now going to be replaced by somebody who is really, really far to the extreme on the right.”

Welter believes redistricting after the 2020 census also played a role in his defeat by shifting the voters he represented.

In states where partisan officials controlled redistricting, such as Illinois, the maps enacted for the 2022 elections often contained “more and more extreme partisan gerrymanders,” according to a recent analysis by political scientists and data experts.

When legislative districts tilt further right or left, incumbents are more likely to face challengers, and candidates who take more extreme positions are more likely to win, according to an analysis in a forthcoming book by Saint Louis University political scientist Steven Rogers.

Wisconsin’s state legislative districts had some of the largest pro-Republican tilts among all states during the past decade and underwent only minor changes before this year’s election.

Most of the challengers there are likely to lose, said University of Wisconsin-La Crosse political scientist Anthony Chergosky. But they still could leave their mark by forcing incumbents further right to please the GOP base that votes in primaries.

“We are just experiencing a real scramble for power within the Republican Party right now,” he said. “President Trump is really flexing his muscles in directing activists in the party against people like Robin Vos. Anyone in a position of authority in the Republican Party is a target.”
