Justice Department charges 4 Louisville police officers connected to Breonna Taylor killing

Washington — The Justice Department on Thursday filed federal charges against four current and former Louisville police officers connected to the 2020 death of Breonne Taylorwho was shot and killed by police in a raid on her apartment while she was sleeping.

The charges against defendants Joshua Jaynes, Kyle Meany, Kelly Goodlett and Brett Hankison include various civil rights violations, conspiracy, use of force offenses and obstruction. Attorney General Merrick Garland said the civil rights charges against three of the officers stem from alleged falsification of the affidavit used to obtain the search warrant that authorized the early morning raid on Taylor’s apartment.

“The federal charges announced today allege that members of the place-based investigations unit falsified the affidavit used to obtain the search warrant of Ms. Taylor’s home, that this act violated federal civil rights laws and that those violations resulted in Ms. Taylor’s death, Garland said at the Justice Department.

Taylor, a 26-year-old EMT, was shot on March 13, 2020, when officers from the Louisville Metro Police Department (LMPD) stormed into her apartment where she was asleep with her boyfriend, Kenneth Walker. Walker thought the officers were intruders and fired his handgun at them as they were entering, striking one in the leg. The officers fired 22 shots into the apartment in response, one of which struck Taylor in her chest, killing her.

The LMPD fired Hankinson and Jaynes in the months after the Taylor’s death, and the department said Thursday that the police chief had begun “termination procedures” for Meany and Goodlett, who are still on the force.

In charging documents, prosecutors said Goodlett and Jaynes, both detectives, included false and misleading information in an application for the search warrant, specifically that a postal inspector had informed Goodlett that the target of their drug trafficking investigation was receiving packages at Taylor’s address. That was false, prosecutors allege, but Meany, a sergeant and their supervisor of him, approved the warrant application anyway.

“We allege that the defendants knew their actions in falsifying the affidavit could create a dangerous situation, and we allege these unlawful acts resulted in Ms. Taylor’s death,” Garland said, noting that none of the officers who executed the warrant “were not involved in the drafting of the warrant and were unaware of the false and misleading statements it contained.”

The attorney general said Jaynes, Goodlett and Meany also “took steps to cover up their unlawful conduct after Ms. Taylor’s death” and “conspired to mislead federal, state and local authorities who were investigating the incident.”

Jaynes and Goodlett allegedly met in Jaynes’ garage on the night of May 17, 2020, after seeing media reports that a postal inspector had contradicted the information in the search warrant application. The pair devised a scheme to tell investigators a false story about the affidavit, according to charging documents. They both told similar stories about a postal inspector casually mentioning the target was receiving packages at Taylor’s address, a claim they knew was false, prosecutors said.

Meany is also accused of lying to investigators about the officers’ unannounced entry into Taylor’s home. According to charging documents, Meany told the FBI that his officers executed the warrant at the request of the SWAT unit, when in fact he knew that the unit did not put in such a request.

In a separate indictment, Hankison was charged with two counts of deprivation of rights for firing 10 rounds through a window and glass door in Taylor’s apartment after she was killed. Hankison was acquired on state charges of wanton endangerment at trial earlier this year.

The charges come more than a year after the Justice Department opened a civil rights investigation into the patterns and practices of the Louisville Metropolitan Police Department, a probe that is separate and ongoing, a release from the department noted.

“The charges announced today are criminal against individual officers, while the ongoing pattern or practice investigation is a civil investigation that is examining allegations of systemic violations of the Constitution and federal law by LMPD and Louisville Metro,” the department said. “The civil pattern or practice investigation is being handled independently from the criminal case by a different team of career staff.”

Former PlayStation Exclusive Hohokum Comes To The PC On Steam

Hohokum

screenshot: Hohokum

While a big deal has been made about someone former PlayStation exclusives coming to the PC—like Horizon and God of Warno deal was made last week whatsoever about a game with a much lower profile, but which I love regardless.

That game is Hohokumwhich was first released on the PlayStation 4 (and PS3, and Vita) in 2014, and which remains one of the most chill video game experiences available. A collaborative work between artist Richard Hogg, developers Honeyslug and the record label Ghostly, Hohokum is to beautiful 2D adventure where you play as a worm…kite…thing that just floats around its various levels, poking around a colorful landscape just to see what happens.

HOHOKUM | Now Available On Steam

It’s magic. I love this game so much that amidst all the hardware drama and blockbuster releases making up our roundup of the last console generation I wrote a whole thing just about this little game, which I described as being—in terms of meeting its ambitions—perfect.

You move a big snake thing around a floating landscape, and sometimes you run into things, and sometimes you fly through things. You’re never fighting, talking, not really doing much of anything.

Yet for Hohokum these aren’t limitations. They’re a canvas.

It’s a game that understands the links between interaction, visuals and soundtrack to a terrifyingly perfect degree. Each is inspired by and reliant on the other two, to the point where once it gets going Hohokum is almost synaesthesic.

one thing Hohokum is now providing to also be is timeless. Eight years on from its original release its art style hasn’t aged a day, and technically looks as though it could have been released yesterday. The heavyweight soundtrack accompanying it also sounds as good in 2022 as it did in 2014, no doubt helped by the fact that many of the artists involved—like Tycho—are still killing it today.

So if you haven’t owned a PlayStation in a while and never got to check this out, I cannot recommend it highly enough. Annapurna has published this PC version (which, admittedly, is probably why less of a fuss was made than if Sony had released it), and it’s out on Steam now.

Duchess of Cambridge Kate Middleton wears white suit by Alexander McQueen

The Duchess of Cambridge is inspiring our summer dressing for the second time this week, this time with the perfect seasonal suit.

Kate made an appearance at Sandwell Aquatics Center to watch the Commonwealth Games, accompanied by her husband the Duke of Cambridge and their daughter Princess Charlotte, wearing an elegant Alexander McQueen suit with a white tank top and Camilla Elphick pumps.

The duchess wore her hair in her trademark glossy waves, and finished her look with sparkling Mappin & Webb jewellery.

Kate has always been an advocate for re-wearing and this outing was no different; she previously wore the pumps to the polo earlier this summer, while the Alexander McQueen suit made an appearance during her royal tour of Jamaica in March, and then again on Windrush Day in June.

It’s also not the first time we’ve seen that particular jewellery: she first wore the Mappin & Webb ‘Empress’ earrings and necklace at Princess Charlotte’s Christening – a fitting tribute for her daughter’s first solo public engagement with her parents.

Over the weekend the royal inspired our summer daywear wardrobes, in a nautical-inspired look for a visit to Sail Grand Prix in Plymouth.

Kate opted for a classic Breton striped top, worn with tailored white Holland Cooper shorts, gold hoops, and her favorite white Superga trainers. Her style de ella is a constant reminder of how relying on capsule classics and finding your own signature style is key to achieving a chic wardrobe.

It’s little wonder she opts to rewear pieces from her wardrobe so regularly: timeless classics never go out of style.

4 in critical condition after lightning strike near White House

Four people were critically injured following a lightning strike Thursday evening in Lafayette Square, just north of the White House, authorities said.

The four patients, two men and two women, were all taken to area hospitals in critical condition with life-threatening injuries, Vito Maggiolo, a spokesperson for the District of Columbia Fire and Emergency Medical Services Department, said in a Thursday evening news briefing.

The lightning strike was reported at 6:52 pm The victims were near a statue of Andrew Jackson, Maggiolo said, adding that “it appeared they were in the vicinity of a tree.”

Uniformed Secret Service agents and US Park Police officers who were in the area and witnessed the strike provided first aid to the victims, Maggiolo said.

“Their agents, their officers, witnessed this lightning strike and immediately began to render aid,” Maggiolo said.

It’s unclear exactly what the victims were doing at the time.

“All we know for sure is that there was a lightning strike in their immediate vicinity, and all four were injured,” he said.

A CBS News camera that was recording on the White House North Lawn around the time of the lightning strike captured the powerful rumble of the thunder.

“The thunder was so loud, @gabrielle_ake and I jumped up in fright,” CBS News chief White House correspondent Nancy Cordes tweeted. “‘That’s too close – we’re shutting down’ advised photographer Ron Windham.”

ASX set to edge higher as Wall Street struggles for direction

The S&P 500 closed 0.1 per cent lower after wavering between small gains and losses. The Dow Jones Industrial Average fell 0.3 per cent, while the Nasdaq rose 0.4 per cent.

loading

Energy stocks, the biggest gainers in the benchmark S&P 500 so far this year, were the biggest drag on the market as the price of US crude oil fell below $US90 per barrel for the first time since early February, before Russia’s invasion of Ukraine.

Gains in technology stocks, retailers and elsewhere helped keep the losses in energy, health care and other sectors in check.

The muted trading came as investors continued to review the latest updates on the economy and corporate earnings ahead of the government’s monthly snapshot of the nation’s job market Friday.

Investors are eyeing jobs data to gauge whether any tightening in the labor market might prompt the Federal Reserve to eventually ease up on its interest rate hikes as it fights inflation, potentially lessening the chance of the central bank bringing on a recession.

“They wanted to quell demand and temper inflation and they wanted to do so without unduly impacting the labor market in a negative way,” said Katie Nixon, chief investment officer for Northern Trust Wealth Management. “So far, the Fed is going to assess all of this as according to plan and they’re going to keep going.”

The S&P 500 slipped 3.23 points to 4,151.94, and the Dow dropped 85.68 points to 32,726.82. The Nasdaq rose 52.42 points to 12,720.58. The Russell 2000 index of smaller company stocks gave up 2.47 points, or 0.1 per cent, to close at 1,906.46.

All of the major indexes except for the Dow are on pace for weekly gains after rallying Wednesday.

The price of US crude oil fell 2.3 per cent to settle at $US88.54 per barrel Thursday, weighing on energy company stocks. Exxon Mobil slid 4.2 per cent and Occidental Petroleum fell 5.8 per cent.

loading

Stocks have meandered this week, leaving major indexes mostly higher. August’s gain follows a standout July that was the S&P 500’s best month since late 2020. But markets remain volatile as investors try to determine the economy’s path ahead amid the highest inflation in four decades and efforts from central banks to fight higher prices.

The Federal Reserve has been aggressively raising interest rates to try and slow the economy and fight inflation, along with other central banks. The Bank of England on Thursday initiated its biggest rate hike in more than a quarter of a century.

Recent economic data from retail sales and employment reports has shown that the economy is already slowing down.

“The cure for high inflation is sometimes high inflation,” Nixon said. “The narrative that we might have been at or past peak inflation is being validated by some of the data coming out.”

At Forrester Creations, Brooke updates Katie on the latest about Steffy and Finn by phone. She’s sure to point out that Bill did a good thing. As she disconnects, Hope walks in with Deacon. She did not know her mother de ella was still there, and she had assured Deacon that Ridge is in Monaco. Deacon reflects on how happy Ridge and Taylor must be for Steffy and Finn. Brooke nods and sighs.

In Monaco, Kelly asks her mommy why she’s crying. Steffy explains they’re happy tears. The little girl is happy too. At Forrester, Deacon tells Hope her line is fantastic. She’s glad he likes it. Deacon wonders if his daughter’s ever thought about modeling as a full-time career. Brooke calls them over to see Taylor’s photo of Steffy and her de ella family and squeals, “They’re so happy you can feel it through the screen.” She muses, “Destiny 2.0 maybe?” Hope teases that title may be reserved for her and Liam. Brooke apologizes. Hope was just kidding and gushes, “This is such an amazing day.” She wants to capture it forever and says, “Let’s take a photo!” The three of them pose for a selfie.

In Monaco, Ridge notes that Taylor’s phone is blowing up. It’s all the likes and comments about Steffy and Finn. Ridge thinks the world should celebrate them for what they were put through. Taylor doesn’t want to think about Sheila, she’d rather focus on the good stuff. Ridge remarks that they went through something too, and Taylor recognizes that they’re always there for one another when it counts. Suddenly, she sees something on her phone and blurts, “Oh!” Ridge asks what she saw but she replies, “Nothing to see here.” Ridge isn’t buying it and asks what it is. Taylor claims it’s a random picture. He wants to see it. Taylor hands her phone over — it’s Hope’s selfie of her from Ella, Brooke and Deacon. Ridge grumps, “Well, that’s cozy.” He reflects that he asked her to stay away from that guy, and then he goes on a trip… “How about them apples?” Taylor takes him outside for some air.

Outside in Monte Carlo, Finn and Steffy canoodle. She marvels, “This doesn’t feel real.” She thought he was gone and never coming back. Coming back was all he thought about. She can’t stop staring at him — it feels like a dream. Finn assures her it’s real and then enthuses about the magic of Monaco. Steffy says, “It brought me you.” Finn agrees, “It will always be our special place.” Steffy shows her husband his ring from her; she carried it with her always because it made her feel close to him. Placing it back on his finger from him, something she never thought she’d be doing, she whispers, “My husband is back.”

Elsewhere, Taylor and Ridge stroll and she apologizes for the photo. He points out he would have seen in eventually. He wants to say he’s surprised but… He flies halfway across the world to help his grieving daughter de ella and she’s spending time with Deacon. Not wanting to focus on it, Ridge remarks on the beauty of Monaco. They reach an overlook and Ridge tells Taylor he’s been his rock from her. “I’ve never been so proud to have kids with you.” Taylor marvels that it’s been a whirlwind… it makes it seem like anything is possible. They embrace and then Ridge goes in for a sexy kiss. They make out as a helicopter drones past in the distance.

More: The B&B/Y&R crossover that would beat all

By the beach, Steffy can’t believe Finn is here or that he’s alive. Finn fought so hard for this moment. “Nothing and no one was going to keep me from you and my family.” He recalls how he would think of her when he was recovering and he promised himself — and her de ella — de ella that he would keep fighting. How painful it must have been for her, thinking he was dead all this time. Steffy nods. Their perfect little family was gone, like it never existed. She vows never to take him or their love for granted. “I didn’t really believe in miracles until today.” They express their love and share a deep kiss.

David Warner unlikely to play in inaugural ILT20

David Warner is unlikely to play in the UAE’s inaugural International League T20 (ILT20) in January, and looks set to remain in Australia with ongoing negotiations to have him play in the Big Bash League (BBL) for the first time since 2013.
Warner, who is contracted to Cricket Australia but doesn’t hold a BBL deal, is set to be available to play franchise cricket in January 2023 after the three-match ODI series with South Africa was canceled and there was significant interest for him to play in the UAE, particularly given his IPL franchise Delhi Capitals own the Dubai Capitals franchise as well.

But ESPNcricinfo understands that a potential deal to sign Warner to the ILT20 is almost certainly off and Warner’s manager James Erskine confirmed to the Sydney Morning Herald that they were in negotiations with CA and the Australian Cricketers Association (ACA) to have Warner play in the BBL.

CA has found itself in a bind over the prospect of Australian contracted players, who are not contracted in the BBL, potentially being offered $US450,000 to play in the UAE.

The last Test of a three-match series between Australia and South Africa concludes in Sydney on January 8, 2023, with Australia’s next international commitment not until mid-February when they are due to tour India for a four-Test series. This means that Warner, Steven Smith, Pat Cummins, Mitchell Starc and Josh Hazlewood, among other Test players, will be available to play franchise cricket in that period. CA had hoped that all would play in the BBL given it runs from December 13 to February 4, while the ILT20 is scheduled to run from January 6 to February 12.

The CA-contracted players are not obliged to play in the BBL under their contracts and Warner and Starc haven’t played since 2013 and 2014 respectively, while Smith, Cummins and Hazlewood also don’t have BBL contracts. Starc has already confirmed he won’t make himself available in order to rest while Warner is the only one publicly linked to the UAE so far, although Cummins and Hazlewood have been sought-after recruits in the IPL in recent years and would attract a lot of interest.
Australia’s high-profile T20 players like Glenn Maxwell, Marcus Stoinis, Mitchell Marsh, Matthew Wade, Adam Zampa, Aaron Finch and Tim David all have BBL deals. The big restriction for the players’ potential earnings in the BBL is the $AUD1.9 million ($US1.32 million approx.) salary cap with top contracts in the BBL for Australian players maxing out at roughly $AUD190,000 ($US132 ,000 approx.). There are significant marketing bonuses available on top of that but the total a player can earn in the BBL is still dwarfed by the top contract in the UAE for a shorter tournament.
There has been disquiet among the players about the BBL’s decision to offer $AUD340,000 ($US236,000 approx.) to top overseas players who have been nominated in the draft. A significant portion of that contract will be topped up by CA outside of the club’s salary cap. There is further disillusionment at the fact that a number of those overseas players are likely to only be available for the December portion of the BBL and will then head to the UAE to play the full ILT20 in January for nearly twice the money.

It is written into CA, Australian domestic and BBL contracts that players need “written approval” in the form of no-objection certificates (NOCs) to play in overseas leagues but it is understood that a restraint of trade argument could be mounted under Australian common law should a player wish to go down that route. That contract clause has warded off players from making any decisive moves to the UAE this year but the ILT20 has given Warner the ability to bargain with CA and command a similar sized and structured BBL contract to what the “platinum” overseas players will get this season .

There has been speculation that Chris Lynn would also require an NOC despite not being contracted to a BBL club due to an ICC player-release regulation stipulating players still need NOCs for two years after holding a contract in Australia. But ESPNcricinfo understands that it would be unenforceable as an unreasonable restraint of trade under Australian law. Shane Watson, the current ACA president, previously played in the Bangladesh Premier League in 2019-20 without an NOC having retired from the BBL earlier in the year. It is unlikely, however, that Lynn could play in both the BBL and the ILT20.
Ricky Ponting and Usman Khawaja forecasted these issues last month highlighting the potential earnings gap between the BBL and the South Africa and UAE T20 leagues for both Australian and overseas players.
All of this is taking place as CA and the ACA prepare to start negotiations in the coming months on a new long-term MoU for the players to come into effect in 2023. One of CA’s major broadcast partners Channel Seven has also filed a Federal Court action against CA to terminate their current deal that expires in 2024 over perceived quality breaches in regards to the BBL specifically.

Sen. Kyrsten Sinema signs off on Democrats’ big agenda bill, paving the way for Senate passage

Sen. Kyrsten Sinema signed off on sweeping Democratic legislation Thursday addressing climate change, health care and taxes, all but ensuring passage of the bill in the Senate.

The Arizona Democrat said her support came after Democrats removed a provision on closing the so-called carried interest tax loophole that helps wealthy private equity and hedge fund managers pay lower taxes.

“We have agreed to remove the carried interest tax provision, protect advanced manufacturing, and boost our clean energy economy in the Senate’s budget reconciliation legislation,” Sinema said in a statement Thursday. “Subject to the Parliamentarian’s review, I’ll move forward. “

Sinema’s comments on the bill, known as the Inflation Reduction Act, come after it won the approval of Sen. Joe Manchin of West Virginia, another moderate Democrat. She was viewed as the last hurdle to move forward on the legislation.

Sinema had long been opposed to a provision in the deal Manchin cut with Senate Majority Leader Chuck Schumer that sought to change carried interest.

In her Thursday statement, Sinema said she hoped “to enact carried interest tax reforms, protecting investments in America’s economy and encouraging continued growth while closing the most egregious loopholes that some abuse to avoid paying taxes.”

Democrats are aiming to pass the legislation ahead of the August recess in an effort to revive elements of President Joe Biden’s agenda before the midterm elections.

“I am pleased to report that we have reached an agreement on the Inflation Reduction Act that I believe will receive the support of the entire Senate Democratic conference,” Schumer said in a statement Thursday. “The final version of the Reconciliation bill, to be introduced on Saturday, will reflect this work and put us one step closer to enacting this historic legislation into law.”
