Federal judge rules that Georgia commission elections discriminate against Black voters

A federal judge ruled on Friday that holding statewide elections for a Georgia utility regulatory body discriminates against Black voters and delayed the elections scheduled for November to a later date.

Steven Grimberg, the US district judge for the Northern District of Georgia, said in the ruling that the statewide election for the state’s Public Service Commission, which oversees residents’ access to telecommunications, electric and natural gas services, unlawfully dilutes the votes of Black citizens .

Two seats on the five-member commission were scheduled to be up for election in November. Current state election law requires a candidate for a seat on the commission to live in one of the five districts they are running to represent, but voters from the entire state can vote for all five seats regardless of where they live.

Grimberg wrote that the election system for the commission violates the 1965 Voting Rights Act’s second section, which states that no qualification, standard, practice or procedure can be imposed by any state to deny citizens’ right to vote based on race or color.

The plaintiffs are Black voters in one of the districts where an election was set to take place in November. The ruling states that they testified that they have not been prevented from voting in Georgia because of their race, but that race plays a role in the election.

Experts testified that there is “strong evidence” of racial polarization in the elections and that Black and white voters are “cohesive” in the candidates they support. But because the number of white voters outnumbers the number of Black voters, the Black-preferred candidates do not win.

One expert said during the case that the candidate supported by white voters won 11 out of 11 times since the current state law went into effect, and another expert testified that only one Black candidate has ever been elected to the commission, despite Georgia’s large Black population. .

The Atlanta Journal-Constitution reported that an attorney for the defendant, Brad Raffensperger, who oversees the election in his capacity as Georgia secretary of state, argued that Black voters have been able to fully participate in the political process. The attorney said Black-supported candidates not winning does not mean that the voting system is discriminatory.

The ruling states that the attorney for Raffensperger said during a preliminary hearing that the state would have the current incumbent commissioners running in the races “holdover” in their positions until a new election can be held.

Nicolas Martinez, the attorney for the plaintiffs, said in a statement that the court’s decision vindicates their argument that Georgia’s statewide election method for the commission unlawfully dilutes Black votes.

“This ruling immediately impacts how millions of Georgians will elect those powerful officials who determine how much everyday folks must pay for basic utilities,” he said. “It is one of the most important decisions to advance voting rights in a generation.”

In a video uploaded on Thursday, the comedian responded to a TikTok her daughter Vivienne made where she claimed her mother, “has done so much for me and I am so incredibly, incredibly thankful for her, but one thing she has not done is normal.”

This back-and-forth began when Vivienne responded to comments on her TikTok story-time series that praised her parents for keeping away from the vices of Hollywood as a child.

One comment in particular said Rosie seemed to have “kept things relatively normal” for the children.

“I love all these comments about how Rosie kept my life ‘normal’. No offense mum, that never happened,” said Vivienne. “She just didn’t really inform us, for really anything.”

Minnesota jury rules that pharmacist who denied woman morning after pill didn’t violate her rights

A jury in Minnesota ruled on Friday that a pharmacist did not commit discrimination when he did not fill an emergency contraception prescription for a woman after her prior contraceptive method failed, according to the gender advocacy group Gender Justice.

A jury in Aitkin County found that a pharmacist’s decision not to provide an emergency contraception prescription to plaintiff Andrea Anderson after citing his “beliefs” did not constitute discrimination.

According to court documents, Anderson went to the only pharmacy located in her town to retrieve a prescription of emergency contraception after another method failed, but the pharmacist there rejected her request.

The filing further claims that she would later have to drive more than 100 miles in total in order to get her morning after pill after having several pharmacies reject her request.

Anderson was awarded $25,000 over emotional harm caused by the initial pharmacist who rejected to fill the prescription.

“I can’t help but wonder about the other women who may be turned away,” Anderson said in a statement.

“What if they accept the pharmacist’s decision and don’t realize that this behavior is wrong? What if they have no other choice? Not everyone has the means or ability to drive hundreds of thousands to get a prescription filled.”

The legal director for Gender Justice, which is representing Anderson, said it plans to appeal the decision.

“To be clear, the law in Minnesota prohibits sex discrimination and that includes refusing to fill prescriptions for emergency contraception,” Gender Justice Legal Director Jess Braverman said in a statement. “The jury was not deciding what the law is, they were deciding the facts of what happened here in this particular case.”

Moment Brad Pitt almost lost first movie role

The director of an obscure Serbian film has shared the moment she “discovered” award-winning actor Brad Pitt as a young adult looking for his silver-screen debut, and how she was almost turned off giving him his start.

Before the fame of blockbuster productions like Ocean’s Eleven and Mr & Mrs Smitha pimply but “electrifying” 21-year-old Pitt responded to a casting call from the agency of Lauren Lloyd, former executive vice-president of Hollywood Pictures and Trust Sony pictures.

Lloyd described her first meeting with the young wannabe who would become a megastar back in the ’80s to Aussie podcast What is Was Like.

“So this kid walks in and I think he had done maybe one or two episodes in a soap opera… and I was like, who’s this kid? But it was like God walking in” Lloyd told the podcast.

“So I said ‘sit down and talk to me’, and he had kinda bad skin… but he seemed very calm for being one so young and non-experienced.”

At 21 years old, Pitt had minimal acting experience and was looking to enter the film industry.

Lloyd’s talent agency had agreed to scout a male lead for a Yugoslavian-US co-production The Dark Side of the Sun.

And by the time young Pitt read the script to them, Lloyd and her work partner were “giggling with delight” at the actor they had found.

“We were like who is he? This guy is magnificent,” she said.

But despite Pitt having successfully charmed the two talent scouts, Lloyd revealed she almost didn’t cast him because of his lack of experience in film.

“I said ‘but he just does TV’ – because we were at that stage when the people in the movie business we looked down upon television… they were making the money but we were making the movies,” she said.

After her partner assured her “you’ve got a movie star!” the pair hired Pitt for his first ever movie gig working with Yugoslavian directors.

“And Brad was so excited, he was like a kid,” Lloyd added.

They call it the ‘X-Factor’

It’s the quality that distinguishes ordinary people from “stars” who become globally and critically acclaimed artists.

And that’s exactly what Lloyd saw in Pitt the day he walked in and read his first film script.

A large part of film success she conceded, was down to genes – being born with a face for camera.

“Well (Pitt) had shaggy hair and kind of bad skin but you’re still … captivated by it,” she said.

“He was almost too pretty, he had very delicate features – he’s grown into a much more manly man – but he was just quite a beautiful creature.”

But looks alone don’t drive the “X-Factor” she said, and when it came to Pitt, what made him “electrifying” was his “calm” and “holistic” presence.

“(He was) so united inside – and when I say that I mean for someone so young to be so comfortable in their body, to be intellectually there.” she said.

“So it’s a spiritual, intellectual, and physical blending… and there he was – magnificent looking.

“So when someone likes that walks into a room you see them – but you feel them. It’s almost like every cell in your body is electrified.”

Lloyd said Pitt had been “blessed” with an “incredible combination of genes” which gave him that “movie star quality” that talent agencies look for.

But pretty faces come and go, she acknowledged, and to make a long-lasting career in the Hollywood film industry, actors have to be persistent.

“When you go to Hollywood, you have to have that (self-belief) no matter what you do,” she said.

“(Because) if you don’t have that drive it’s so difficult… you’ll perish away… you have to be so driven that no matter how many times you get ‘no’, you’ll find a way.

“And he had that.”

Indiana becomes 1st state to approve abortion ban post Roe : NPR

INDIANAPOLIS — Indiana on Friday became the first state in the nation to approve abortion restrictions since the US Supreme Court overturned Roe v. Wade, as the Republican governor quickly signed a near-total ban on the procedure shortly after lawmakers approved it.

The ban, which takes effect Sept. 15, includes some exceptions. Abortions would be permitted in cases of rape and incest, before 10-weeks post-fertilization; to protect the life and physical health of the mother; and if a fetus is diagnosed with a lethal anomaly. Victims of rape and incest would not be required to sign a notarized affidavit attesting to an attack, as had once been proposed.

Under the bill, abortions can be performed only in hospitals or outpatient centers owned by hospitals, meaning all abortion clinics would lose their licenses. A doctor who performs an illegal abortion or fails to file required reports must also lose their medical license — wording that tightens current Indiana law that says a doctor “may” lose their license.

“I am personally most proud of each Hoosier who came forward to courageously share their views in a debate that is unlikely to cease any time soon,” Gov. Eric Holcomb said in the statement announcing that he had signed the measure. “For my part as your governor, I will continue to keep an open ear.”

His approval came after the Senate approved the ban 28-19 and the House advanced it 62-38.

Indiana was among the earliest Republican-run state legislatures to debate tighter abortion laws after the Supreme Court ruling in June that removed constitutional protections for the procedure. But it is the first state to pass a ban through both chambers, after West Virginia lawmakers on July 29 passed up the chance to be that state.

“Happy to be completed with this, one of the more challenging things that we’ve ever done as a state General Assembly, at least certainly while I’ve been here,” Senate President Pro-Tem Rodric Bray told reporters after the vote. “I think this is a huge opportunity, and we’ll build on that as we go forward from here.”

Sen. Sue Glick of LaGrange, who sponsored the bill, said that she does not think “all states will come down at the same place” but that most Indiana residents support aspects of the bill.

Some senators in both parties lamented the bill’s provisions and the impact it would have on the state, including low-income women and the health care system. Eight Republicans joined all 11 Democrats in voting against the bill, though their reasons to wart the measure were mixed.

“We are backsliding on democracy,” said Democratic Sen. Jean Breaux of Indianapolis, who wore a green ribbon Friday signifying support for abortion rights, on her lapel. “What other freedoms, what other liberties are on the chopping block, waiting to be stripped away?”

Republican Sen. Mike Bohacek of Michiana Shores spoke about his 21-year-old-daughter, who has Down syndrome. Bohacek voted against the bill, saying it does not have adequate protections for women with disabilities who are raped.

“If she lost her favorite stuffed animal, she’d be inconsolable. Imagine making her carry a child to term,” he said before he started to choke up, then threw his notes on his seat and exited the chamber.

Republican Sen. Mike Young of Indianapolis, however, said the bill’s enforcement provisions against doctors are not stringent enough.

Such debates demonstrated Indiana residents’ own divisions on the issue, displayed in hours of testimony lawmakers heard over the past two weeks. Residents rarely, if ever, expressed support for the legislation in their testimony, as abortion-rights supporters said the bill goes too far while anti-abortion activists expressed it doesn’t go far enough.

The debates came amid an evolving landscape of abortion politics across the country as Republicans face some party divisions and Democrats see a possible election-year boost.

Republican Rep. Wendy McNamara of Evansville, who sponsored the House bill, told reporters after the House vote that the legislation “makes Indiana one of the most pro-life states in the nation.”

Outside the chambers, abortion-rights activists often chanted over lawmakers’ remarks, carrying signs like “Roe roe roe your vote” and “Build this wall” between church and state. Some House Democrats wore blazers over pink “Bans Off Our Bodies” T-shirts.

Indiana’s ban followed the political firestorm over a 10-year-old rape victim who traveled to the state from neighboring Ohio to end her pregnancy. The case gained attention when an Indianapolis doctor said the child came to Indiana because of Ohio’s “fetal heartbeat” ban.

Religion was a persistent theme during legislative debates, both in residents’ testimony and lawmakers’ comments.

In advocating against the House bill, Rep. Ann Vermilion condemned fellow Republicans who have called women “murderers” for getting an abortion.

“I think that the Lord’s promise is for grace and kindness,” she said. “He would not be jumping to condemn these women.”

First of all, Daniel Ricciardo announced ahead of the delayed 2020 season that he would leave the French outfit – then running under the Renault marque – at season’s end to move to McLaren for 2021, prompting then-team principal Cyril Abiteboul to question Ricciardo’s loyalty.

Then on Monday, Fernando Alonso felt the F1 paddock into a frenzy announcing he was jumping across the English channel to join Aston Martin for next season – a big step down the grid on this year’s form.

It seemed perfectly set up then for Oscar Piastri – the Alpine reserve driver whose development they’ve invested millions of dollars into – to slide into Alonso’s seat.

Alonso wanted two years in the race seat of an F1 car. Alpine wanted two years as well – but only one in their F1 squad. They wanted the second year to be at the wheel of their new LMDh prototype in the World Endurance Championship.

So sure they were Alpine that Alonso would not find anywhere offering what he wanted, that they had all the power in the negotiations, they seemingly let the deadline pass.

Unbeknownst to them, their complacency allowed the two-time world champion to go tire-kicking, only for the Spaniard to stumble across exactly what he was looking for.

As for Piastri, Alpine believed they have a cast-iron contract that would see him in one of their cars next year. Having said that, in the world of F1 cast-iron contracts can be melted by cold hard cash.

For Piastri to so publicly denounce his employer, he and his management are either positive that Alpine contract is not so cast iron, or his 2023 bosses – Zak Brown at McLaren – are ready and willing to burn a lot of cash to bust him loose.

Woman arrested in high-speed crash that killed 5 in Los Angeles County

A woman accused of causing a crash that killed five people, including a pregnant woman, Thursday in Los Angeles County has been arrested, according to the California Highway Patrol.

The driver, Nicole Lorraine Linton, 37, was hospitalized with moderate injuries and faces a charge of vehicular manslaughter with gross negligence, Highway Patrol said in statement

Linton is from Houston, but she worked locally as a nurse, authorities said.

The driver was behind the wheel of a Mercedes-Benz that was traveling at “a high rate of speed” when it went though a red light and smashed into cross traffic in the Windsor Hills community, southwest of downtown Los Angeles, on Thursday afternoon, the CHP said in a statement.

“As a result of this collision, multiple parties were ejected and two vehicles were fully engulfed in flames,” the CHP stated.

Five people were declared dead at the scene and eight were hospitalized with injuries ranging from minor to moderate, according to Highway Patrol.

The Los Angeles County Coroner’s office identified the pregnant victim as Asherey Ryan, 23. Her fetus did not survive the crash and her 11-month-old son was also killed. Her son’s identity was still pending, officials said.

NBC Los Angeles reported Ryan was headed with her son to an appointment with her prenatal doctor, who was to update her on her pregnancy, when her vehicle was struck.

Ryan and her fiancé were expecting a baby boy, who they planned to name Armani, her family told the station.

Ryan’s mother, Sharita Randleston, told the station she wants the suspect in the crash held accountable. “She needs to pay for her actions de ella,” she said.

Security video of the crash appears to show the dark Mercedes coupe traveling with no sign of deceleration southbound on La Brea Avenue, a wide street used as an alternative to often-packed Interstate 405, into bustling traffic on Slauson Avenue.

Officials said the collision was so powerful, with vehicles burned to the ground, they’re still having a hard time determining which victim was in which vehicle.

Two women and a man were killed, according to the coroner’s office, but additional identities have not been released.
